William asks…
What can i do about a company harassing me about a payday loan?
Im being harassed by this company in Florida saying that they have a lawsuit against me because i refuse to pay off a payday loan. I also received a previous call from this number saying that i had a warrant out for my arrest and that they were sending police to my house. When speaking with this company I told them that i did pay it off and they said the money they collected from my account was not going towards the payoff but it was fees. The loan amount was for $200 and i gave them well over $300 before i closed the bank account because of this issue. Later to find out that these loans are illegal in my state. So do they have a case against me or is it just a scam? Im not so much worried about them threatening me with the lawsuit but the fact that they have all my personal information including my ssn and what they can do with it.
i dont have a mailing address or email of the company, just the phone number

Loans Guide answers:
You can’t be arrested for failure to pay a debt. They would have to sue you to collect what you owe.
If you want them to stop calling you, copy and paste this text (with the appropriate parts changed to match your case) into a letter to them and they will not be allowed to make further contact or they can be fined.
In re: Account Number xxx
This letter is to advise you that pursuant to Section 805(c) of the Fair Debt Collection Practices Act, the consumer—that’s me–wishes the debt collector to cease further communication with the consumer by phone calls to (000) 000-0000 effectively immediately and communicate only by mail.

Donna asks…
I want to find how to contact Total Lending Payday Loan, either an e-mail address or 800 #.?
I have a payday loan I want to pay off with this company and I can’t find the address for them and they just keep taking cash from my checking acct. every 2 weeks and don’t e-mail or call me to make arrangements for a pay-down or pay-off, which I know is a scam and that is why I want to get them paid off and their hands out of my cash… Thanks for any information anyone has on this company. I expect there is at least one more “name” this company hides under so it is hard for someone like myself to find them on a web site, so if anyone knows other names please let me know, I REALLY want to get this issue resolved quickly…. Thanks, VIcki Dugger

Loans Guide answers:
I am in the same prediciment as you. I also have a loan with this company. But, I might be able to help. This morning I found what I believe is their fax#. I had the name Elisa written next to it and I do remember she is the person who helped me with my loan. So, you can try faxing them a note at this number and telling them you want to pay off your loan or ask them to contact you. I hope this helps. When taking out these pay day loans it is best to keep the paper work you sign and fax to them because it usually has the phone number on it. I accidentally lost my paper work but I did at least have this fax number written down. 1-866-379-7667
You’ll want to research this some more….

Sandra asks…
what can i do if a payday loan company is taking money from me without me authorizing it. it seems like a scam?
The problem is, they have been deducting $90 every two weeks from my account and I had no info about this company. I finally found some on-line the company name is magnum Z LLC and when i spoke to the one guy over the phone he said i authorized it. kept stumbling on his words and when i asked for a voice record of me authorizing it he said no and i asked why he said cause he said so. he said he would report me to collections and i really don’t want that to happen. I paid them more than the loan amount was which was for $300 and they still are taking money out. they said that the $90 are finance charges and that I needed to call to pay down the loan so none of the $90 went to the principal in other words. I don’t know what to do. Help please.

Loans Guide answers:
First you need to contact your bank and tell them that someone is debiting money from your account that you didn’t authorize. They’ll make you complete some forms stating that the charges were fraudulent and you’re disputing them etc. You also need to write the company a letter asking for proof of the loan, any finance charges and pay off amounts to date. If they cannot or will not provide that information, I would tell them that I was contacting my attorney and filing a claim with the Better Business Bureau.
You may have to go as far as closing your account and opening a new one to stop them for automatically debiting the money. It’s a painful process but it might be the best thing to do because:
1. They cant take your money anymore
2. They would be forced to send you a letter or contact you regarding what you owe (because the eft would bounce back to them)
3. It wouldn’t affect your credit because the payments would return to the company as a closed account (you have proof of fraudulent activity) and not NSF
Don’t let it go on for too long otherwise it will look like you agreed to the charges.

Chris asks…
Call from a foreigner about a payday loan?
I have 2 current payday loans and I am making my payments on them. However, I am receiving a lot of calls from this foreign speaking person and he is arguing with me that I owe them and I don’t. I don’t know where he got my information from, but I am paying on my two loans like that I am supposed to be. He says that he is an investigator and he is calling from somewhere in California. I have tried to tell him that I don’t know anything about his company and he starts arguing with me and I cannot get a word in when he is rattling on and on. I told him to contact my family attorney and he says that he can’t do that. He said that if I don’t straighten it out that he will have to turn it over to my local sheriff’s office. So, I told him to go on and do that. I am tired of messing with him. I believe he is running some type of a scam. Has anyone else had this happen to them?

Loans Guide answers:
Do not talk to this person – if he calls again tell him that you are demanding that he cease all contact by phone and that he can only communicate with you through mail
This is a scam – if you are paying on time then a scammer might have hacked your loan company’s database
Never get in conversations with these people – tell him to put it in writing and tell him the call is being recorded as the other poster says. If you feel you are being threatened or extorted for money, file a police report for harassment

Helen asks…
Where do I go for a loan without paying $$ up front?
I have bad credit and am trying to consolidate payday loans. I don’t have money for up front fees or Nigerian lenders who want to scam. Please advise.

Susan asks…
Anyone know how to get out of payday loan hell in illinois?
Sarcastic, rude, and snotty comments need not be left. In this economy people, I recently being one of them have no choice but to turn to all means needed to get by. Up until 2009 I was living well, my husband however is now because he is a union worker in a construction field isn’t working. I also since 2008 have taken over a $8000 cut in my pay, so while we have cut back it seems like it just isn’t getting better. I made a huge error in getting a payday loan, something I’ve said I never did. They are vicous, found my self having to get another just so as I could pay the interest. So now I have 3! I pay $35, $75, and $55 a paycheck (every 2 weeks) But I can’t afford to pay these off. Starting this JAN sadly his insurance was cut off and I had to take it out, its $400 a month less that I am making. So while I thought I could just pay these off now because of my insurance I just can’t and I got my self into this horribe circle. I don’t want to close my bank account, nor do I want these lenders calling my job. Any GOOD positive adivce would be appreciated. I would love for them to stop debiting the finance charge and set up monthly repayments? Not sure they will do this though. HELP!!! Please

Loans Guide answers:
Closing your bank account won’t solve the problem. Just force them to sue you. Closing the bank account does not get you out of the loan.
The only way out is to pay it off. As you’ve learned, getting another pay day loan is not the answer.
Look around the house. What can you sell? Any clothes that are in good condition? Electronics? Anything you can list on Craig’s List and Ebay. Donate blood plasma if you have to.
Do you have a flea market in your town? If so, are you crafty? Do you have the ability to make something you can sell. Is hubby a wood worker? Can he make things to sell?
Can you take on a weekend job? That added to the things you can sell will help chip away at the debt.
Hubby is not working. He’s going to have to start doing something. Spring is coming. Tell him to start putting up fliers and advertising that he will cut grass and do lawn work. Maybe he can’t work construction right now but landscaping companies should start cranking up soon. He needs to contact companies and see if he can get a job. He can contact the local day labor companies. Most of these don’t need skill workers – they need muscle. Maybe he can advertise as a rent a hubby. Do those little honey do things for folks who don’t have a hubby handy enough to do those little things. If he has too…tell Hubby to appy to every local pizza joint and start delivering pizzas. Hubby’s not working is not going to work any more. If he can’t do construction then he needs to get off his fanny and start doing something. And any 1 thing may not be enough. He may need to do every thing I’ve suggested. But unless he has a major illness that physically prevents him from working – he needs to start doing everything he can to contribute to the house hold income.
You don’t have a debt problem. You have an income problem. The only way that I see to get out of the trap is to cut your spending to the bare bones. The only time you see the inside of a restaurant is if you are working in it. Then you have to increase your income and get these loans paid off.
Good luck to you.

Donna asks…
i need a payday loan and can’t get a lender i need one bad?
i have tryed for days now and i just keep being sent to different web sites i just need to get 500 dollars to pay a house payment
please someone help me i don’t know what to do

Loans Guide answers:
Have you tried pay day places around town?
Have you tried taking things to the pawn shop?
They will give you cash, about 1/3 of the value of things.
If you fail to return the cash, they keep the items.
Do you own your car title free of loans?
Does your town have car-title lending services?
Have you tried going to your bank and simply asking for a short term loan?
Also consider family.
Take anything of value to them and ask them for cash.
If you don’t return the cash, they keep the items.

Chris asks…
How do you rate the Republican stalling tactics to prevent Financial Reform and keep the big banks and payday?
lender raking in the cash and taking the change from our pockets?
So far it seems to be working as planned, stalling until the pesty amendments such as a 50 cent cap on debit card fees and allowing the payday lenders to keep charging 300% interest on short term loans.
I personally feel that we should applaud the valiant efforts of Republicants to keep the rich rich and the poor poor. That is their agenda, is it not?

Loans Guide answers:
Your last paragraph is exactly what brainwashed liberals are taught. Keep repeating a lie, and eventually the entire weak-minded group will accept it as truth. Yawwwwn….

William asks…
Where can I go to get a bad credit personal loan (unsecured)?
I have bad credit and need a loan. I don’t want to take chances with payday lenders, car title lenders, or with my house. All I need is a quick $2,000. Any advice?

Loans Guide answers:
If you have a bad credit history still the loan market place is full of lenders who are ever willing to offer you a fresh loan. But you should be meeting some conditions laid down by the lenders. Loans for bad credit people are in fact easier to get then they were ever before, thanks mainly to cut-throat competition amongst the lenders. Lenders are giving loans to the bad credit people who have late payments, payment defaults, arrears, county court judgments or any credit problems. These loans are available for any purpose like home improvements, purchasing a new or used car of your choice, for wedding and holiday tour, debt consolidation or for paying child’s tuition fees.
Every lender in approving loans surely likes to see if the bad credit borrower has sufficient capacity to repay the loan in timely manner. If the borrower earns well, has regular bank balance, has been an employee for some years and has a convincing loan repayment plan in place, then the lenders do not usually hesitate much. So ensure that you have adequate repaying capacity before applying for a loan. Also, you should first check your credit report for any errors. If your credit score is too low then you would be charged a very high rate of interest. So it is advisable to first pay off some easy debts to improved credit score and then you should apply for loan at better rates.

Sharon asks…
DOES ANYONE REALLY FIND HONEST LENDERS??
I HAVE BEEN SEVERAL PLACES LOOKING FOR A LOAN NOT PAYDAY LENDERS BUT HONEST LENDERS WHO HAVE ACTUALLY HELPED PEOPLE WITH LOANS AND CAN BE VERIFIED .

Loans Guide answers:
If you are looking for an unsecured loan you prob will have a hard time getting it from any legit lender.
A bank might issue a credit card, depending on your credit. But no bank is going to issue a unsecured loan to anyone one right now. Even in good times, getting an unsecured loan from a bank is virtually impossible.
All those pay day and related loans charge high rates of interest like Guido on the street corner in the bad part of town. Avoid Guido.

Sandy asks…
A man called me saying that I did not pay a payday loan and legal action was going to be taken against me…?
A man called me from an unknown number. I did not answer, because I don’t answer unknown or blocked numbers ever. He called twice then left a message. He said that he was looking for [my name] concerning a sensitive matter that he could not disclose on my voicemail. He then left his number which was (646)525-4064 and said that if I did not call back, he would assume that I was trying to escape the law and this could put me in a “big mess”! It sounded suspicious but I did call back anyway.
When I got on the phone, he told me that I had been named the prime suspect in some case involving social security numbers. Oh, he was foreign so I couldn’t even understand everything he was saying so I would have to ask him to repeat it. Then he said something about Big Payday loan filed a suit against me because I had not paid a loan back that I took from them. Last year, I did take out quite a few payday loans, but my credit union helped me pay all ELEVEN of them off and I haven’t heard from anyone since then. He said they had emailed me but I had not responded back. I am trying to run far far away from payday loans because they almost destroyed me, but I never took out any loans with this company. When I do receive emails, I usually unsubscribe so they don’t mail me anymore or send them to spam. I searched my emails to make sure and saw their name a few times where they sent an email for me to take out a loan, but they were just generic emails to attempt to get me to take out a loan. Nothing else.
Anyways, the man said that he worked with legal consulting company to help rectify this situation before legal action is taking. He said the name of the company, but I can’t remember it for the life of me. I also did a reverse phone number lookup and it was a cell phone number out of New York. But anyway, I ended up cutting him off and telling him I don’t owe any more loans, thank you, and hung up. He then called me back twice. I didn’t answer anymore and he left me two messages. The first message said something to the effect that the cops were coming unless I attempted to pay my debt. The second one just said something about call him back so we can discuss my options.
My question is…is this some kind of scam going around? And can I report this character? Also, if I truly still owed a payday loan, wouldn’t the company do more than try to send me emails? Wouldn’t they try to call me and tell me? I’m not scared or anything. This is just crazy to me so I just wanted to ask questions concerning this issue so maybe someone can help me. I am not calling him back. I’m thinking the payday loan companies are mad, because I paid off my debts and not requesting any more money neither am I responding to them anymore…I don’t really know what’s going on….
Anybody with any insight, please let me know….
Thank you for your answers…No, I did not give out any information guys! I hung up on him and that’s when he called back and I did not answer!

Loans Guide answers:
It’s a scam. They are doing it to try and get your personal information. I hope you did not give them any information.

Michael asks…
is this true? canyou go to jail for a payday loan?
Ok, I applied for a few payday loans awhile back, but never actually got one. I never signed any agreement or whatever. Today I get 12 messages on my answeing maching from some guy in california (i live in vermont). He told me that I now have a lawsuit against me because I took out a payday loan, and never paid it, but i never had a payday loan!! Then he said I am going to be supenad (sp?) into court, a court in california, and if i dont show up i will be arrested. I dont get it? How can i have charges for a loan I never even had, or signed for? How can they make me go to court in california, when i live in vermont. Finally, since I am pretty sure this is some sort of scam or something, who should I call to report these jerks? I live in Vermont thanks
I did ask for proof, and the guy said “you’ll get your copies in court”, and i know i didnt have a payday loan, i did apply for a few, but never was apporved, or went through with it..but they keep calling like every 15 mins, is there anyone i can call to report them? to make this stop?

Loans Guide answers:
Someone may have got your information somehow and applied for a loan in your name. However, seeing that payday loan companies require an active checking account to secure the loan, I think you are safe. Check your account to make sure that no automatic debits have been placed. If none have, then don’t worry about it. It is illegal for any debt collector to threaten someone in any way whatsoever, especially with jail. And no, you cannot go to jail or be arrested for debt. Debtor jails used to be quite common, but they are illegal now. For more information on your rights, go to http://www.fair-debt-collection.com/
The next time they call, get the caller’s name and the agency they represent. Google the phone number. You would be surprised what information this brings up. Contact your state attorney general‘s office with your complaint and the above information.

Robert asks…
where can I find a real guaranteed unsecured personal loan for people with bad credit other than citifinancial
I’ve tried alot of these speedy loans and bad credit loans and citibank and am coming up with nothing. I don’t want to have to pay for anymore loanfinders and I’ve even ran into a scam or two. Somebody please give me some advice. And no payday loans either! Please!

Loans Guide answers:
It sounds like your credit is just too poor to qualify for loans. Instead of looking for a loan, you should figure out other ways to come up with cash. Have a garage sale, get a second job.
Make yourself a strict budget and live within your means.

Ruth asks…
A “law office” contacted me about a payday loan (that I forgot about). They said they are with Mark Goldberg?
They said the outstanding loan was sold to a broker because it was an unpaid debt. It is for $300.00. I am willing to pay it but, I am hesitant because they are asking me to deposit the money into the law offices account via Bank of america. The gentleman sent me a letter of agreement via email. I asked him if he could send the letter to me via mail which he said he would. He could not tell me which loan place the loan originated from (I only know one payday loan place it is) which i contacted and they said the account was sold to a broker. Should I pay the debt or does it sound like scam? I have already had this happen once.

Loans Guide answers:
Ask for the documents that assigned the claim to the current holder. He or the claim holder should have a copy on file.
This is a reasonable request to make sure that you are not being scammed. The assignment documents should clearly reflect the chain of custody.

Betty asks…
do big banks own any payday lenders?
seems to me they can keep you trapped in the decline mode while steering you to payday lenders thereby getting money from you without ever approving you for a traditional loan

Loans Guide answers:
They do actually. It’s a new trend. Both of the banks that I bank with – Wells Fargo and Bank of America offer payday advances. They are offered only to established customers of their bank and the amounts are determined by the amount of income you have regularly deposited into that account.
As with any payday advance, it should be avoided like the black plague and never touched. Even with these two large financial institutions, their fees and interest charges are outrageous.
If you don’t have the money now for something (including emergencies) what makes you think you’ll have it later to pay back?

Sharon asks…
Get me out of Payday Loan HELL!!?
I was foolish and got way in over my head with payday loans. I finally closed my account and now I owe about $2000 to six different lenders. Does anyone know how I should proceed? Joseph asks…
How long does it take wefixmoney.com to find lenders?? I have been on the same screen for an hour.?
im trying to get a payday loan. It has been searching for lenders for a while now. Is there another site i can use or does this one really work?

Loans Guide answers:
Here is what the site FAQ says I do not take loan but here is some info from that site you mentioned…
I applied for a loan earlier today. When will I know if I got approved?
When you are approved, you are directed to your approving lender’s website within a few minutes of applying on WeFixMoney.com. If the system is still searching for a match after 10 minutes, we’re having trouble finding a lender who will accept your application. If no one contacts you within an hour of submitting, your loan was denied.

Mandy asks…
Quickest way to get a payday loan?
I’ve been trying to get a quick payday loan but every time I fill out the form for one site I get to a lender that makes me fill out out another form and this cycle just repeats itself again and again. Can anybody tell me a site where I just have to fill out ONE form to get a payday loan?

Loans Guide answers:
With due respect, and from what I gather on this site, payday loan is not the way to go. I would do my best to find another solution to these financial woes, take another look at my finances and maybe start cutting in the fat. (What is a necessity to some is excess waste to others).

Helen asks…
I need a long term installment loan(not a payday loan) I have bad credit.?

In that case your fam+friends will be your best bet but even with them you’ll have a credit limit.

John asks…
question about consolidation……?
Okay, I made some bad decisions and took out a couple payday loans, they are killing my paycheck each month. And, I have some high credit card bills because of my husbands illness. Before he got onto health insurance we were paying for his insulin (expensive) plus we have a 1 and 2 year old in daycare and diapers. So, I just wonder about debt conslidation. has anyone used it…? Does it really work….? Is is a good idea?

Loans Guide answers:
I would recommend to speak to a credit counselor. Make sure it’s from a non-profit, accredited place. They could advise you about things like a consolidation loan or if you needed more help like where they will work with your creditors to help you pay off your bills. My friend did it and paid off a lot of debt in something like 3 years. I think it’s a good idea.

Linda asks…
Auto loan for debt consolidation?
I have less than perfect credit, and I was wondering if I could apply for an auto loan in order to consolidate and pay off all my payday loan debt of about $5000? Ive tried getting personal loans but I can’t get approved anywhere, and I need a solution fast because all my payments are about to be due.

Sandy asks…
I need financial help/advice! PLEASE
?
okay so currently i am at a stand still financially. its kind of worrying me because i can barley make ends meet and i have no other financial support from anyone else. even financial advice for that matter. the only person i can turn to is my other half, however my other half if currently unemployed so that kind of makes matters a little worse, but its so hard to find him a job, we’ve like put it over 100 applications all over and no luck so far, but heres the thing. here is the question id like to ask and get SERIOUS advice and help with. I am 19 and I am in debt. not 10k debt, id say around 3k or so. out of everything, i believe what is hurting me most is the numerous payday loans i have out there that i have made to try and have extra cash in my pocket. what is hurting me every 2 weeks i get paid is renuing them, and i want to get out of them so badly so i could pay other things that i owe with my check and at least for once in these 5 hectic months have something to last me off of my check till the next check for like gas, food and such. i want to know what would be the best method in getting out of all these loans and start getting down to business. also if someone would happen to know where i would be able to make a debt consolidation loan or some kind of loan that would help someone like me out, esp with the fact that i am from louisiana and the economy sucks out here. i tried onemain financial however i couldnt b/c i needed a co signer and i dont have that. i want to try to find some kind of place that would let me borrow like 2k to get out of some of this debt.
my payday loans are as follows
a. 60.00—borrowed 50
b. 190.00—borrowed 150
c. 280.00—borrowed 225
d. 345.00—borrowed 290
e. 305.00—borrowed 250
i am not sure of the interest rate on these loans but every two weeks when i renew them, the “fee” i pay to get what i borrowed back is
a. 10.00
b. 40.00
c. 55.00
d. 55.00
e. 55.00
other debts are 411.00 overdraft in one bank accnt, abt 400 owed to a credit card that i havent been paying on because i couldnt afford it. i also had to let my insurance lapse because i couldnt afford to pay it and that is 447 i owe to them and i guess on top of that what i will have to pay also to the dmv and that is about it. i need help of advice if possible. the reason why i believe i got into all this mess is because a while back i was trying to help someone and a loan that i had weeks before that and didnt pay back went to my accnt and took all my check and from then on i basically had to make loans every so often to keep money in my pocket. also on average i make 80 hrs a week at my job and get paid 9.50. i hope this helps the people that are reading this and are interested in my story. thank you for your support.
im sorry// correction….i make 80 hrs every 2 weeks (40/per week)
@talk turkey : i made a correction; is it possible you could revise your answer since that particular info i provided wasnt correct
@ tony p : unfortunatlly my better half has a few mental disabilities that refrains him frm working in public however we have put in overtime to find something suitable for him so that he can help out because he reallllly wants too. im in a bad situation i guess that i regret ever getting myself into. i wish i want so naieve to money savings and everything. i feel like im going to be stuck forever. then on top of that i have school coming up in the spring and i have to juggle all of this!. my life is a living hell

Loans Guide answers:
80 hours a week at your job? At $9.50/ hour?
You are getting 40 hours of overtime (time and a half).
^ Louisiana has laws on this.
With that kind of income, you should be able to get out of this mess easily.
Work on those pay day loans first.
Then work hard to get car insurance.
I believe Louisina is one of those states with napoleonic laws.
You could go to jail for driving without liability car insurance.

Chris asks…
Thank you all for your answers to my questions.?
So, what you guys are saying is that I can place the two payday loans that I have on my bill consolidation? Oh, with all my medical bills and my other bills I owe a total of around 5,000.00. And to the person who said that I should get a job and pay my bills. I have a job where I have been employed for serval years I just had got hurt and I was off of work for awhile and couldn’t pay all my bills that’s all. I had gotten the two payday loans before I had got hurt.

Loans Guide answers:
You can’t pay any attention to the negative answers on here.

Nancy asks…
What credit card do I have a chance of getting with bad credit?
my credit score on experian is 524, I am looking for a credit card with low or no initial fees or yearly fees but I can have a high interest rate because I plan on paying it off each month to build up my credit. does anyone know a card that would be most likley to approve me with this criteria?
I was pre approved for first premier bank card but with all the fees it ended up being 250 – 300 debt before I would even spend a penny on the card. and thats before eve n knowing the balance.
im not looking to go into more debt, Ive been paying off debt I had from 8 years ago, for about a year now on a debt consolidation plan. for some reason it didn’t start showing i was paying current till january, even though I have been paying on the card since july. I contested the charges of being late paying and even called my debt consolidation organization to see what they can do about it. my credit score SHOULD NOT BE AS LOW AS IT IS!
the reason I want the credit card incase you are wondering, is I have to get a rental car and all rentals require a credit card. also we are short about $200 for our vacation because we didn’t budget having to get a rental. we are going to ride down with a friend to san antonio but now she has decided not to take her car. she doesn’t have good credit either. about as good as mine. so I cant have her get a rental.
this is why I cant get a prepaid card right now, I know they build on credit, I would like to get one, but you have to put money upfront and my money is going to be tight until half way through our vacation on the third when my hubbie gets paid.
then well have more than enough to pay off the the credit card
dont want to be condsidering pawning or payday loans because the interest is so high even when you pay on time unlike a credit card
and for any one who wants to be captain obvious and say shouldn’t of had bad credit to begin with and you wouldn’t be i this mess…you are preaching to the choir. i ought to have know better but have since learned my lesson and am diffinalty paying for it
for an entire year now I have been paying 400 a month toward old credit card. whats your smart butt remark compared to that?
wow, I said alot, hope this explains everything. only looking for credit card solutions at this point, if you dont have3 any, dont answer.
thanks
lol, im not a dude, I realized im on his account, but im a girl. rolf

Loans Guide answers:
Try Orchard Bank and H.S.B.C. They both are pretty good about giving cards to people with damaged credit.
Good luck.
