is anyone aware of payday loan co. giving your bank info to third parties claiming you authorized debits?

I applied at a payday loan co. and 3 times I ended up with debits from my account. Twice was for $19 for applying but the kicker is when $49.99 was taken from my account for a secret cash card? I found out where it came from and they claim I checked yes to one of the boxes on a payday loan appl. authorizing this third party company to send a check through my bank ordering a secret cash card thats a prepaid debit card thats suppose to give me online privacy when purchasing and protect me from companies and people from getting my personal info. Now it seems like I need that very protection from the stupid people thats selling it or fraudulently debited my account! The bank told me that when I applied for the loan I authorized the third parties to debit my account for various things. My thing is If your applying for ONE thing such as a payday advance how can it’s friend tom who sells shoes, joe who sells dog food and mary who sells secret cash cards legially take that money out my bank ?
Besides if I needed to apply for a payday loan then I didnt have money in the first place for no secret cash card and the funny thing is I never even got the loan!

Can I take legal action against a website that stole my information and sold it?

The other day I was looking at payday loan sites (yes I know terrible idea) and I found one that interested me. I filled out the information they asked for (including my SSN and bank account number) and after I submitted it they immediately told me I didnt qualify. Right after that my inbox got flooded with spam. I get about 300 spam emails a day now. I also keep getting phone calls and texts that are just spam. Somebody also tried to access my bank account but the bank stopped them. I confronted the website via online live chat (their phones “are not currently working”) and they swear up and down they dont spam and that its not from them. It has to be though because I never got spam before that and a majority of the spam was for payday loans. I want to know if there is some kind of legal action I can take against this site. They stole it because it was a loan application. They sold it to a bunch of spam sites so yes, I would consider that stealing. Seeing as they do not provide loans and just spam you, I would consider that stealing.
Wow spammers are so fucking retarded. Im asking if I can take a spammer to court and I get a bunch of spam replies offering me loans. I hate the internet.

A couple of issues…

The website did not steal your information. You typed it in and gave it to them.
Was there anything on the application that stated that your personal information would not be shared with anyone else? Lots of sites will sell or share e-mail lists with other companies, resulting in spam mail.
The violation I see offhand is the attempted entry into your bank account. I do not know how detailed the records are that your bank keeps, such as the address/name of the entity that was trying to access the account. Also bear in mind that you gave the loan site your bank account number. Did you read all the fine print? There may have been wording in there stating that by giving them your account number you were authorizing them to access the account. You need to be very careful about throwing around that information.

I seriously doubt that your computer has been hacked. The issue started after accessing and leaving information on another site, so if anyplace was hacked, it would be the website.

I can not advise whether it would be beneficial for you to pursue bankrupt.
I would recommend that you look into it as only a last resort – remember those laws have changed as well .
Your young enough to make a financial recovery that does not involve having that on your credit record potentially harming you more than a few paid collections that will disappear 3 years earlier that a bankruptcy – a without the stigma.

Yeah I was dumb, the checking and savings where never tied together.The payday loan tried to force it open, before the due date of the check, so I closed out the checking account,yes I have to pay them but not thru my savings account? I honestly do not think the bank can legally give your financial information to anyone or place of business without a conscent form signed by you. Unless while applying for the loan you signed an agreement to have your savings withdrawn in the event of nonpayment of the loan. (which I doubt considering it deals with checking accounts and not savings). The only account number the payday loan co has is your checking and you since have closed it. I will tell you that by not paying the loan you have created a big problem for yourself. The payday co has a legalized document signed by you and your promise to pay. It will go to court and it will cost you BIG TIME!!! They then will cease your savings and possibly garnish your wages by holding a judgement against you. This happens every day to many people who end up in the payday loan trap. Be smart and don’t let it go this far. You will end up paying three times the amount of the loan including late fees and court costs. As far as the unknown hidden costs you speak of. When applying for the loan you should have gotten a reciept or paper explaining the costs, interest, and the due date.

A man called me saying that I did not pay a payday loan and legal action was going to be taken against me…?

A man called me from an unknown number. I did not answer, because I don’t answer unknown or blocked numbers ever. He called twice then left a message. He said that he was looking for [my name] concerning a sensitive matter that he could not disclose on my voicemail. He then left his number which was (646)525-4064 and said that if I did not call back, he would assume that I was trying to escape the law and this could put me in a “big mess”! It sounded suspicious but I did call back anyway.

When I got on the phone, he told me that I had been named the prime suspect in some case involving social security numbers. Oh, he was foreign so I couldn’t even understand everything he was saying so I would have to ask him to repeat it. Then he said something about Big Payday loan filed a suit against me because I had not paid a loan back that I took from them. Last year, I did take out quite a few payday loans, but my credit union helped me pay all ELEVEN of them off and I haven’t heard from anyone since then. He said they had emailed me but I had not responded back. I am trying to run far far away from payday loans because they almost destroyed me, but I never took out any loans with this company. When I do receive emails, I usually unsubscribe so they don’t mail me anymore or send them to spam. I searched my emails to make sure and saw their name a few times where they sent an email for me to take out a loan, but they were just generic emails to attempt to get me to take out a loan. Nothing else.

Anyways, the man said that he worked with legal consulting company to help rectify this situation before legal action is taking. He said the name of the company, but I can’t remember it for the life of me. I also did a reverse phone number lookup and it was a cell phone number out of New York. But anyway, I ended up cutting him off and telling him I don’t owe any more loans, thank you, and hung up. He then called me back twice. I didn’t answer anymore and he left me two messages. The first message said something to the effect that the cops were coming unless I attempted to pay my debt. The second one just said something about call him back so we can discuss my options.

My question is…is this some kind of scam going around? And can I report this character? Also, if I truly still owed a payday loan, wouldn’t the company do more than try to send me emails? Wouldn’t they try to call me and tell me? I’m not scared or anything. This is just crazy to me so I just wanted to ask questions concerning this issue so maybe someone can help me. I am not calling him back. I’m thinking the payday loan companies are mad, because I paid off my debts and not requesting any more money neither am I responding to them anymore…I don’t really know what’s going on….

Anybody with any insight, please let me know….

Ok, I applied for a few payday loans awhile back, but never actually got one. I never signed any agreement or whatever. Today I get 12 messages on my answeing maching from some guy in california (i live in vermont). He told me that I now have a lawsuit against me because I took out a payday loan, and never paid it, but i never had a payday loan!! Then he said I am going to be supenad (sp?) into court, a court in california, and if i dont show up i will be arrested. I dont get it? How can i have charges for a loan I never even had, or signed for? How can they make me go to court in california, when i live in vermont. If none have, then don’t worry about it. It is illegal for any debt collector to threaten someone in any way whatsoever, especially with jail. And no, you cannot go to jail or be arrested for debt. The next time they call, get the caller’s name and the agency they represent. Google the phone number. You would be surprised what information this brings up. Contact your state attorney general’s office with your complaint and the above information.

They said the outstanding loan was sold to a broker because it was an unpaid debt. It is for $300.00. I am willing to pay it but, I am hesitant because they are asking me to deposit the money into the law offices account via Bank of america. The gentleman sent me a letter of agreement via email. I asked him if he could send the letter to me via mail which he said he would. He could not tell me which loan place the loan originated from (I only know one payday loan place it is) which i contacted and they said the account was sold to a broker. Should I pay the debt or does it sound like scam? I have already had this happen once.

Ask for the documents that assigned the claim to the current holder. He or the claim holder should have a copy on file.

This is a reasonable request to make sure that you are not being scammed. The assignment documents should clearly reflect the chain of custody.

A lawyer keeps calling my phone saying that a payday loan company based out of California has my social security number and all of my information. A professional attorney would send you a letter with all the information you need about the loan.

You probably should contact your local police about this. If you can punch *69 on your phone, after the guy calls, and try to get his number. That will give the police something to go on. Or, you can contact your phone service provider and ask them where the call is coming from, that it is a scam, and you want to report it.

If you wrote a check without having the funds to cover the check, you are guilty of writing a hot check.

Check Georgia statutes of limitation on writing hot checks. If the statute of limitation has expired, they cannot put you in jail.

However, keep in mind that the statute of limitation in Georgia is six years on written contracts. The collection agency cannot have you arrested for owing a debt. All they can do is threaten until they take you to court and get a civil judgment against you.

Will they do that? That depends on the size of the debt and their ability to collect on the judgment,

I’m only asking, is because I’ve been trying so hard to get out of them. I do at one point,. But that’s only by closing my checking account and than settling it by a fraction of the cost. I seriously doubt the payday loan folks will be able to put him in jail if he doesn’t pay. We don’t have debtor’s prison in the US. Typically the payday loan place already has access to your bank account. Did your friend close that account?

Payday loans are bad. The interest rate is like 600%. If you don’t pay, the collectors are very nasty and don’t mind breaking the rules. The normally require access to your bank account and make you sign an agreement to allow garnishment of your wages if you don’t pay. Thus they don’t bother with credit checks.

You friend needs to pay this off. He needs to find the cash some place other than another loan. Have a garage sale, pawn something, sell blood, collect alum cans, get a second job — pizza delivery has flexible hours and you get tips.

I had to get me a payday loan over the internet.Everything seemed fine and I got the loan,but 2 days after the loan money was deposited in my account,”companies” , I don’t even know, started to with draw money, for different things, out of my bank account without my knowledge. You can try to take legal action, but they will probably just tell you someone authorized the transactions, and for all you know that’s true. It may not be the loan company, but a dishonest employee. You should definitely close the account. Most banks, though if you file a fraud dispute, are more than happy to forgive fees and change your account number. It protects them and you from further loss when your account has been compromised. File a police report and contact your bank immediately, even for the one you were refunded on. I’ve had it happen before where the company returned the money but put the fraudulent debt into collections. The police report will offer some protection.

I need to know if a payday loan company can legally charge 125% interest without telling you in the agreement?

I borrowed $ 200 from an online lender and the agreement said my total repayment would be $260.
I thought that was a bit steep as is. so I called on the phone and was told that that is the total charges i would be required to pay. now that the loan is repaid they say the $260 was just the finance charge and now I owe another $260. I have bad credit..Payday loans messed up my bank account. I need money by Monday 5/14/07 help?

I need aloan to pay off my childrens tuition, pay my summer tuition, and reregister my girls for the fall. I have a great job, but had a family crisis( oldest daughter got Lukemia) and I had to pay for treatments til Medicare was approved. I had a few payday loans, payng on time, until one of them went in a day early and tried to get their entire balance. That was not the arrangement, and they messed up my account, which caused a trickle down effect on every other account that was ACHed from that account. Not to mention the bank bounce check fees. I am working on getting those items corrected but now I need $4000. Any idea where I can look…fast. Without this last payment, my daughters will not be able to take finals and they will have to repeat the entire grade. I can verify all I have said. Let me express something. I have no family, part of my debt comes from the house that was forclosed on when I had my stroke, and I loss everything in it, and the payday loan thing. With that said, it is not that I run up debt, I live in a cheap 1 bedroom so my girls could go to that school, and yes I will take a semester off if I have to. The point is I still have to pay their tuition for this month and register them, or they will loose their spot. I live in NM & I am on the verge of total financial collapse with payday loans. I am on the verge of being homeless. What will happen if I do close my checking account, thus not allowing ACH payments & opening up another account. What if I choose to default completely? Will it be reported to the credit bureaus? Will I be forced to pay no matter what? I need some good answers please. I am desperate.

One problem is Most banks won’t actually let you just close an account. Most require a 1 month waiting period after you tell them you want to close your account and sign the paperwork.
