I’m only asking, is because I’ve been trying so hard to get out of them. I do at one point,. But that’s only by closing my checking account and than settling it by a fraction of the cost. It’s quite aggravating! The interest is so high. You have to take out a payday loan to pay off another one sometimes! I mean a lot of people have money problems, I Just wish I never had gotten into it. Is anyone else in this situation? And how did they get out of it? You can’t write a check from a savings account. You can only write a check from a checking account. Does he have money in this checking account? Why can’t he just go withdraw the $100?
I seriously doubt the payday loan folks will be able to put him in jail if he doesn’t pay. We don’t have debtor’s prison in the US. Typically the payday loan place already has access to your bank account. Did your friend close that account?
Payday loans are bad. The interest rate is like 600%. If you don’t pay, the collectors are very nasty and don’t mind breaking the rules. The normally require access to your bank account and make you sign an agreement to allow garnishment of your wages if you don’t pay. Thus they don’t bother with credit checks.
You friend needs to pay this off. He needs to find the cash some place other than another loan. Have a garage sale, pawn something, sell blood, collect alum cans, get a second job — pizza delivery has flexible hours and you get tips.

what can I do about unauthorized checking account with drawls form unknown businesses?
I had to get me a payday loan over the internet.Everything seemed fine and I got the loan,but 2 days after the loan money was deposited in my account,”companies” , I don’t even know, started to with draw money, for different things, out of my bank account without my knowledge. At first I thought it was just a mix up in the account number or something like that, but it happen 3 times, always a different company. I did get a refund from one of them,and still waiting on a refund from the others.But the last transaction from one of them left my account with an overdraft fee.
What can I do to stop these actions? without closing my account.
I’m almost afraid to deposit any more money into my account,but yet, I have to pay for the overdraft fees the banks charges me.
Can I contact the BBB and report the Loan company as ” illegit”? or report the companies that withdraw money from my account?
Can I take any legal actions against those companies? if so, how would I go about it?

You can try to take legal action, but they will probably just tell you someone authorized the transactions, and for all you know that’s true. It may not be the loan company, but a dishonest employee. You should definitely close the account. Most banks, though if you file a fraud dispute, are more than happy to forgive fees and change your account number. It protects them and you from further loss when your account has been compromised. File a police report and contact your bank immediately, even for the one you were refunded on. I’ve had it happen before where the company returned the money but put the fraudulent debt into collections. The police report will offer some protection.

I need to know if a payday loan company can legally charge 125% interest without telling you in the agreement?
I borrowed $ 200 from an online lender and the agreement said my total repayment would be $260.
I thought that was a bit steep as is. so I called on the phone and was told that that is the total charges i would be required to pay. now that the loan is repaid they say the $260 was just the finance charge and now I owe another $260. I refuse to pay 520 dollars for a $200 loan. What are my rights? they have my checking account # and the payments have been coming out eletronically.

Your rights and obligations are what you agreed to in the contract. Payday loans are an expensive scam and you are finding out why.
Usually, a lot of the high fees are charged upfront with “origination” fees, “service” fees, “contract” fees and the like. So, they really aren’t lying when they give you a particular interest rate, but you are still obligating yourself to a LOT of money.
You can, and should, complain to your state’s Attorney General and the Federal Trade Comission, but chances are you signed a legal contract so you will still have to pay up to get this to go away.
If you believe a lender has violated the Truth in Lending Act, file a complaint by calling the Federal Trade Commission Consumer Response Center toll-free at 1-877-FTC-HELP (382-4357).

Payday interest too much….?
I had to take out $2500 in payday loans to pay some emergency medical bills. The interest alone is going to cost me $550 each pay period (twice a month). I know all of the horror stories of taking these out, but I had no one else to get a loan from. I looked up several companies that say they can negotiate with the payday loan lenders, just like when you consolidate credit cards. I was wondering if anyone had ever heard of or knew anyone that had done business with PDL Assistance or Langhorne Debt Solutions. PDL Assistance told me that I could have these paid off in 10 months with a $230/month payment. They will email me the contract and I have to send them the form back that authorizes them to talk to my 3 lenders to negotiate the loans. They will also send me a form to take to my bank that will stop the 3 lenders from withdrawing any further debits from my account. They did not tell me to close my account. Any suggestions?

I wouldn’t use those consolidattors – they’ll ding your credit report and charge high fees.
If you’re really solid financially and can pay it off, I would try to get vetted by prosper.com and see if you can get a small loan to float this off – you may need to do one small loan and pay it off to show that you’re credit worthy.

payday lenders do not report to credit bureaus, big banks can keep you trapped in the turn down cycle, while still making money off you without approving you for a traditional loan, is this not a violation of the ecoa act of 1974?

Pay day lenders do report you to credit agencies. I have seen many people come into the bank to apply for a loan (auto, consolidation, personal, etc) and when their credit is pulled they have dozens of loans from payday lenders. No lending officer in their right mind would loan money to someone that uses a payday lender as they have proven they can not manage their income properly. Besides the fact, people using payday lenders typically don’t pay bills on time so their credit score is likely lower than average.
So, given the fact the credit score is lower and a payday loan is a derogatory credit note, lenders can deny traditional loans without violating the Equal Credit Opportunity Act.

Do not get the online payday loans. If you have to get a payday loan, at least go to one where you walk in a store and talk to the people who run it.
They do not run your credit, they go by how much you make in a pay period. The most they can lend is $425, and you will have to pay back $500. You will have to bring in your paycheck stubs, check book, a utility bill with your name and address on it, drivers license, possibly your SSN card and a pint of blood (ok, that last part was just being funny)
They will charge close to 400% interest on the loan, and a lot of people find themselves in a revolving cycle of just renewing the loan and paying the fee or interest. They are very difficult to get out from under.
Do not do this if you cannot get it paid off in the time frame of a month. Otherwise, you are going to get sucked into the cycle.
The ones on the internet tend to debit your checking account on the day the loan is due, and if it isn’t in there, you get slammed with not only overdraft from your bank but fees from the payday loan.
Also, the ones you go to in person, you have to pay them back in cash..they do not cash your check. (unless you don’t show up to pay them..LOL)
Also, be aware that in some states, Payday loans are illegal, and if you are in the military you can no longer get a payday loan.

You are essentially writing a bad check – which is a federal offense.
When writing a bad check – they will take you to jail.

I don’t think the reason that payday loan office didn’t asked to check your credit before giving you the cash advances was because they knew you. Most all payday loans, or cash advance, services do not require credit checks. You mostly have to prove your identity and that you have the ability to repay it.
Payday loans get a lot of criticism mainly because people always unfairly compare them to regular loans like you would get at a bank. Those are set up with monthly payments installments that you pay back over time. A payday loan is exactly as it sounds “Hey loan me a few dollars until my next pay”. Which means in about 7 to 14 days later the full amount that you borrowed, plus the fee, must be paid back. So, of course, if you compare the two then the payday loan interest rate will appear extremely high. Many people say that comparing cash advance payday loans to regular traditional installment loans is apple and oranges. But I feel since they are actually both loans it more like comparing oranges to a grapefruit.
But that was my little rant I needed to get off my chest. The truth is there is the potential for a lot of people to get in trouble with payday loans because they misuse them, keep renewing them, and become dependent on them. However when cash advances are use only as they are intended, like for emergencies (the car breaks down, the ac goes out, etc) they are an absolute life saver.
I’ve needed to use them in the past. My car actually did break down. I didn’t have any other way to get to work. I could not afford to miss any more days. So I feel the payday loan very much help me keep my job. But I paid it off… And I didn’t go back and get another one next week.
Ryan M’s response is not helpful at all. It isn’t even an answer. So he’s on the wrong forum. I think we all already know there are better options (for those that can get them) and payday loans are kind of a last resort.

The main difference between getting a payday loan online vs. Walking into a business is, of course, convenience. And you will have to give them your banking information. Because all of the online payday loan companies I’ve checked out will deposit the money directly in your account. And on the date it is due, they will draft the money directly out of your account. They will contact you by phone first. They will give you all the necessary information. Including the exact date, and the exact amount, you need to have in your account to repay it. Then you make the decision whether, or not, to accept the cash advance.

should i get some payday loans?
i know this sounds terrible, but hear me out. i am pretty unfamiliar with payday loans.
i am going across the country with a friend this summer, and i will need some cash. i am currently unemployed in northern new england and i have yet to find a job. the situation is quite dire up here, and i’m sure some of you know how it is.
anyway… if i can’t find a job when the time comes, i was thinking about getting some type of easy loan (i.e. a payday loan?) as my credit is very poor and i have no source of income. i have seen some online payday loan companies that claim they do no job checks – however im not sure that this is true… i’ll look into it further.
my question is such: what legal rights do they have? i know there is a contract and yadda yadda but will the retaliation be anything more than the usual daily harassing phone calls? because i’m used to that already with my college loans and credit card debt, and it really doesnt bother me. so ar am i not in any legal trouble, and i really dont want to end up in court (although i suppose even if i did they wouldnt really be able to squeeze me dry, considering i am a broke ragamuffin).
keep in mind after i get these loans i will be travelling to and perhaps staying forever on the other side of the continent. SO! please keep an open mind and give me your opinions.

The question is not if you “can you get a payday loan”, but rather “should you”. If you are unemployed and do not have any source of income, how are you going to pay it back. I am sure its mentioned in the fine print that they will not verify your job only you meet some criteria. Give it a shot, its worth a try. But mind you the interest rate is ridiculously high and you take the loan only if you are sure you can pay it back. Since you have no income source, please do not take such a loan. You will be in a debt trap forever. If you need some money, reach out to friends or family, or apply for a credit card or personal loan.

I will be starting class online at University of Phoenix. My FAFSA and everything is not enough for my expenses. I need a private loan that I can payback once graduated. After seeing various online ads provided by 5050loan.com (see some of their claims below), along with reading the positive feedback on 5050loan.com in Yahoo Answers already, I was already to try my luck at getting one of their loans. However upon going to their website today (08-03-10), they have a statement on their website that states: “AS OF JULY 19, 2010 WE WILL NOT BE ACCEPTING ANY NEW LOAN PACKAGE SUBMISSIONS DUE TO THE LARGE VOLUME OF SUBMISSIONS WE HAVE REACHED OUR MAXIMUM PROCESSING FOR THE MONTH OF JULY ”.
I have never heard of a business or company having to put potential customers on hold like this. Yet upon doing a little further online research of this company, it looks like they have over advertised and they seem to have quite a few ads on Craigslist and The Backpage and have ads on other various online advertising venues all over the country. Well it must be nice! I sure wish I could get a job working for them if they are that backed-up with business. SMILE! Yet upon reading a few media articles on this company, it seems that they work with several lenders and are not the actual lender themself. So I was wondering if anyone that has a loan through 5050loan.com, can you please provide me your lender name and telephone number. Because I somehow have a feeling that 5050loan.com is going to be swamped for awhile, and I would like to apply for a loan through one of their lenders, since 5050loan.com seems to be the only company out there that might be able to help a person like me in my financial situation get a loan for $25,000, yet if they are that busy at the moment, I hope by going to one of their lenders directly, I can have better luck to see if I can get a loan or not, rather than waiting for 5050loan.com to open their doors to start taking applications once again. It starts with statements like the above telling you you can’t get loans anymore. This phycology makes you want it even more. Thus the second they remove this banner, you will be willing to give them money up front.
You seem like you are stubborn and not open to realities of how business work. NO Business will loan you money if you don’t have a job. The ones that do are in it to rob you blind. They do this all the time, they are experts, you don’t have a chance.

By trouble credit I mean a hospital bill which I’m still being pursued by collectors even though a financial rep at the hospital told me I could and most likely would get help with the charges. She stated that I might be able to get some or 100% aid in this matter which was due to an accident where I avoided hitting an animal at cost of breaking my left meta-carpal. The latter was not truly fair as I had bought a 1992 Dodge (small truck) which less than 2 hours after started smoking and caught fire as headed toward El Dorado, KS to get on turnpike to get to work, cause that’s before I’d quit. The dealership said that not able to use lemon law nor were liable for the vehicle malfunction, thus why they talked me and my uncle into get another one from them.
Then I have my bank accounts which have many issues themselves. Bank of America is a charge off due to unauthorize use of card, due to being stolen, and not know it before wrote checks and then when did find out another issue happened and thus the cops told me that the only thing would get is 460 or little more as restution and BOA said that I’d been responsible as when the card happened to be took before had not noticed until activity not made by me happened and I’d only canceled and got another card since thought misplace or lost it, however. That was not the case and it happened be stolen by people who I just met and was ignorant in trying to help but was scammed and used. Then US Bank tricked me and caused me to have a check account in Topeka, Ks during summer 2008 thus when used my card and thought was savings debit card charged me fees when used it at places like turnpike, comic store, and few more places when balance was low. Thus not find out until the balance was negative and getting collection calls.
I’d not have job yet and was attending Washburn University full time, under Federal Aid and GI Bill, I also used Check Into Cash payday loans and Loan Max to help pay some fees, college, and more. I was successful for awhile until lost my job, was not able to enroll in college again due to hold, and lost car to loan max cause not able to pay of the loan from no money anymore. Thus during Fall 2009 Washburn University was therefore forced into forcing me out of the campus and if not had friends here since been here, I’d been on street or dead due to failure of not able to maintain proper health and security.
I’m currently in need of loan or way to help me get money in legal methods that will help me find stable home or allow me income for dealing with HUD Shelter Plus Care Program (finds homeless people homes). To allow me chance to be able to fully and properly apply for career that I want, such as for now a legal researcher or secretary until get BLS or other BA degree then become a Paralegal and leave it at that since not want more money to owe so not become a lawyer.

I’m sorry to hear of the situation you are in but, in your situation, you will find it very difficult to get any further loans. However, I would suggest that you work on repairing your credit as well while you try to get a loan. Maybe your friends or family would be willing to help.
Unless you repair your credit, you are going to have a lot of trouble getting approval for future loans. I assume you have very poor scores and with such score, even if you do qualify for a loan, the creditors are going to charge very high interest rates. The only thing you can do now is get a decent part-time (or full-time) job and use as much part of your earnings toward paying your debts.

My well pump went out and the repair bill was $2400, I only have $2000 in savings, and no credit cards. I need to borrow $400 or the check will bounce. I hate to get a payday loan, but I feel I have no other choice. Will it hurt my credit to get one? Do they put an inquiry on my credit?

Those type of loans, since they are usually paid back within 30 days do not report to your credit at all. However, a bounced check might. So, in your situation, I think you are doing the right thing.
