I know this isn’t the best way to go about this. I have been analyzing my situation for a long time now and if this isn’t too risky this is what I would like to do. I want to get a car title loan, but because of the spot I’m in, I was wondering if it is possible to get a second title loan as well from another lender? I know that a person can have multiple payday loan lenders so it is the same for title loans?

Well, normally you would have to surrender your clear title to the lender and they hold it until you pay them back, as collateral. So trying to get another loan would be impossible.

You can work out something on your own with the payday lenders. If you give them just $10 a week, they are usually pretty happy, since most people who default on the loans DON’T pay the money back.

In the long run…payday loans are not worth it.
Eventually you are paying more for payday loans than if you had had a regular chking acct & etc.

My 1st wife would do both payday loans & pawn.

1. Pawn:
She would pawn a $125 ring (was her grandmas) many times.
Overall paying about $5800 for a $125 ring, over a 6 year period.

2. Payday loans:
Over similar period she paid nearly 5 times what it costs to have full service banking w/chking & credit cards & atm.

Point being, neithger is a good idea unless its a emergency and your normal access or chocies are not there.

What you are looking for is a consolidation loan. I don’t recommend it. Those loans usually have very high interest rates. If your credit is lacking you won’t get a loan from a bank or a credit union. You could go to an independent loan company, but your interest rate will be god-awful. You should attempt to clean up your credit and current debt as best as you can on your own. Fore go the loan for a minute. Find a reputable credit counseling service. Before you choose one, contact your local Better Business Bureau. Good Luck.

In my last question that I posted- I mentioned that I have a payday loan, I live in Pa…but anyway I cant pay my payday loan- and I already have bad credit- i cant pay it and I was wondering If I could go to jail- or if I will be facing court charges- I mean my daughter, fiance and I live from paycheck to paycheck- and my fiance has one too but she has one too in her name and she recieves SSI and she hasnt even recieved anything and she got it in November or October- I forget- she has one from paydayIsland.com and mine is from CashnetUsa.com
Anyway what will happen court, jail. or just bad credit- i already have been being harrased- thank god for caller id- please let me know- Im kinda paranoid!!!

No, they cannot put you in debtor’s prison as long as you did not commit fraud (actively lying on a loan). Even then it is unlikely you would go to prison for fraud.

EDIT: Fraud means you intentionally misrepresented yourself when taking out the loan. The lender cannot send you to prison, but they can file charges against you AND if a court convicts you, they COULD potentially send you to prison. For such a small amount, it is not likely you would go to prison nor would a court even consider hearing the charges.

Unless you are extremely late, they have not done that and are just trying to scare you. This is the worst loan to get. They charge too much interest and harass people when they are late on payments.

Pay them as soon as possible and never do this again. They will send it to court if you become seriously delinquent (year or so), but if not, they will just continue to call and threaten you.

You cant borrow yourself out of debt. It only brings you deeper in. I know you dont want to hear that, but those are the facts.

Think about it for a minute, you have bills that you are late &/or defaulted on, bad credit, & defaulting on 4 payday loans? Would you loan you money? Stop borrowing from all the various sources & just pay what you currently owe. You will only go deeper into what you are in! You need an influx of money not a new creditor to hound you.

Make payment arrangements, work extra hours, ask family & friends to help out & let them know you cant pay them right away, other wise you will have to add them to your list of collectors. Or contact a credit counseling company to help out. Either way, get rid of the payday places 1st. You will EASILY owe 10x what you borrowed.

Have you tried “The Cash Store” or “Check n’ Go” those are pretty easy to use, you can call ahead for a list of things to bring, I think its a paystub, a bank statement, and maybe one or two other things. Use it with caution, because they’ll let you reborrow every two weeks when you get paid, but you have to pay a fee to use their service. I think to borrow $300 it’s $354 to pay back. If you reborrow you keep paying $54 fee every two weeks until you go in and pay it off or pay it down. So it can be helpful in a pinch, but use necessary caution.

The rest of the online lenders are scammers that will ask her to pay a “security deposit” on the money–and then they will disappear.

Any suggestions on what to do now regarding my soon-to-be-defaulted payday loans?

I began getting payday loans in April of ’07. I was just an inexperienced young adult trying to keep my car and my rent paid for me and my disabled mother. I quickly got trapped into a vicious cycle of debt. I rolled over numerous loans until I ended up with 9 storefront loans!! It finally became too much for me to handle. I’ve even already used extended payment plans with all the companies who would allow, but I ended up going back to reloan to carry over the burden of the remaining loans and my escalating bills. 8 of my loans will soon be in default. I did stop payments on the checks and closed my account and opened a new account. I placed my closed account on credit only status; the bank will now call for authorization for any debits. I just missed my due date for all the loans and haven’t contacted most of the lenders yet. One called me at work and immediately became rude and threatening when I told her I couldn’t pay the total amount or the interest to roll over. She threatened a lawsuit and wage garnishment. I know this is possible, but there is no way I can afford a wage garnishment from 8 separate lenders. I am so nervous about contacting the remaining companies because I know that these places just want their money and do not want to work with you. I am going to draft a letter revoking wage assignment rights and access to my bank account as well as a directive to not call me at work. However I fear that this will not stop these companies from harassing me at work. I know I’ve made a huge mistake and I want to pay but I just can’t pay all at once. The one lady I talked to already denied my request for a payment arrangement. Are there anymore suggestions as to what else I should do?? I don’t want to just sit around and wait for court, and I fear some of these companies will reject any payments I may make. Please help me! I am overwhelmed! I have sincerely learned my lesson. If I pay $50 a month to each lender I can have them paid within about 10-12 months. That’s all I can afford, almost more. Any suggestions or support or advise would be greatly appreciated. Thanks!

1. You can tell them not to call you, but that doesn’t stop them from proceeding.

2. You cannot stop a wage garnishment b/c you don’t have that authority, if they go to court, win a lawsuit, and a judge grants it, your company WILL garnish your wages per the court order.

3. They are not obligated to work with you…you over-extended yourself and agreed to the terms when you took out the money…they should have to lose money b/c you can’t pay it back.

4. I would suggest calling a not-for-profit credit counseling service…they can work with these people on your behalf. If they ask for money up front, they are NOT not-for-profit.

You should go to your local financial institution to seek help. They may be able to help if your credit warrants it. Normally I require security on that type of loan.

Pay day lenders are the hardest credit to eliminate.

If the local lenders cannot help, contact your local Lutheran Social Services or Catholic Charities office. They have debt consultants who have had some success in paying these types of lenders off.

What do you mean by “get in trouble”? You won’t get in any more trouble than you already in, and you are in enormous financial trouble.

You can’t borrow your way out of debt. Your situation is only going to get worse. Payday lenders are vampires, and now that you have let them get their fangs into you they will bleed you dry at 400% interest.

Eventually, one of them is going to realize you cant pay everyone, and they will sue you and get a wage garnishment.

Get a bankruptcy attorney now, while you still can. An attorney must be paid before they will file your case, so you need to begin the process sooner rather than later.

Nearly all consumer bankruptcy attorneys offer free consultations. Take advantage of this to meet with one and get advice based on all of the details of your particular situation. You can find a referral at NACBA.org (National Association of Consumer Bankruptcy Attorneys).

That really depends on the kind of debt consolidation programs you are referring to. Debt consolidation comes in many forms, such as credit counseling, debt settlement, debt consolidation loan etc. But as far as I am aware, not many of these options will not deal with pay day loans (except for maybe a debt consolidation loan, wherein you are applying for a another loan to pay off your current ones).

But don’t lose heart, there are ways to deal with payday loans. These small loans, also called “cash advance loans,” “check advance loans,” or “deferred deposit check loans,” are a frequent pitfall for consumers. A fee anywhere from $15-$30 per $100 borrowed is charged for an average loan of $300. With rates so high and the term of the loan so short there’s no wonder that a very high percentage of these loans are rolled over by the borrower again and again so that the accumulated fees equal an effective annualized interest rate of 390% to 780% APR depending on the number of times the principal is rolled.

There are eight states whose payday loan regulating statutes requires lenders to set up an installment repayment plan if an account reaches the maximum number of rollovers allowed by law and the debtor declares that he/she is unable to pay the balance due.

In most states, the rollover limit will soon be reached, and the interest rate the lender can charge will be capped by state law. If the lender will not accept your payments, simply put what you can afford aside until you have enough money to either payoff the loan or to offer a settlement. Read the regulations in your state to find the best strategy for your situation.
