No, it isn’t illegal. Though it really should be illegal to even have ONE. Those things are viciously predatory and exploitive. There used to be usury laws to prevent that kind of loan sharking. Don’t know what happened to those.

And yes, you can (and should) place that debt on your consolidation plan if you are consolidating.

What happens if you don’t pay on one of those payday loans?

My mom got 3 payday loans to pay for car repairs now she pays 1000 a month just to those 3 and cannot afford any of her other bills. She is on somewhat of a fixed income and I need to help her to stop her from working to death. I have told her just to stop paying them and let them take you to court? Is this good advice?

They will file a lawsuit against your mother to sue her for the amount due along with interest and all court costs. She signed a contract when she got the loans and the contracts are legal binding.

Okay, I made some bad decisions and took out a couple payday loans, they are killing my paycheck each month. And, I have some high credit card bills because of my husbands illness. Before he got onto health insurance we were paying for his insulin (expensive) plus we have a 1 and 2 year old in daycare and diapers. So, I just wonder about debt conslidation. has anyone used it…? Does it really work….? Is is a good idea?

I would recommend to speak to a credit counselor. Make sure it’s from a non-profit, accredited place. They could advise you about things like a consolidation loan or if you needed more help like where they will work with your creditors to help you pay off your bills. My friend did it and paid off a lot of debt in something like 3 years. I think it’s a good idea.

okay so currently i am at a stand still financially. its kind of worrying me because i can barley make ends meet and i have no other financial support from anyone else. even financial advice for that matter. the only person i can turn to is my other half, however my other half if currently unemployed so that kind of makes matters a little worse, but its so hard to find him a job, we’ve like put it over 100 applications all over and no luck so far, but heres the thing. here is the question id like to ask and get SERIOUS advice and help with. I am 19 and I am in debt. not 10k debt, id say around 3k or so. out of everything, i believe what is hurting me most is the numerous payday loans i have out there that i have made to try and have extra cash in my pocket. what is hurting me every 2 weeks i get paid is renuing them, and i want to get out of them so badly so i could pay other things that i owe with my check and at least for once in these 5 hectic months have something to last me off of my check till the next check for like gas, food and such. i want to know what would be the best method in getting out of all these loans and start getting down to business. also if someone would happen to know where i would be able to make a debt consolidation loan or some kind of loan that would help someone like me out, esp with the fact that i am from louisiana and the economy sucks out here. i tried onemain financial however i couldnt b/c i needed a co signer and i dont have that. i want to try to find some kind of place that would let me borrow like 2k to get out of some of this debt.

my payday loans are as follows
a. 60.00—borrowed 50
b. 190.00—borrowed 150
c. 280.00—borrowed 225
d. 345.00—borrowed 290

i am not sure of the interest rate on these loans but every two weeks when i renew them, the “fee” i pay to get what i borrowed back is

other debts are 411.00 overdraft in one bank accnt, abt 400 owed to a credit card that i havent been paying on because i couldnt afford it. i also had to let my insurance lapse because i couldnt afford to pay it and that is 447 i owe to them and i guess on top of that what i will have to pay also to the dmv and that is about it. i need help of advice if possible. the reason why i believe i got into all this mess is because a while back i was trying to help someone and a loan that i had weeks before that and didnt pay back went to my accnt and took all my check and from then on i basically had to make loans every so often to keep money in my pocket. also on average i make 80 hrs a week at my job and get paid 9.50. i hope this helps the people that are reading this and are interested in my story. thank you for your support.

@ tony p : unfortunatlly my better half has a few mental disabilities that refrains him frm working in public however we have put in overtime to find something suitable for him so that he can help out because he reallllly wants too. im in a bad situation i guess that i regret ever getting myself into. i wish i want so naieve to money savings and everything. i feel like im going to be stuck forever. then on top of that i have school coming up in the spring and i have to juggle all of this!. my life is a living hell :(

80 hours a week at your job? At $9.50/ hour?
You are getting 40 hours of overtime (time and a half).
^ Louisiana has laws on this.
With that kind of income, you should be able to get out of this mess easily.
Work on those pay day loans first.
Then work hard to get car insurance.
I believe Louisina is one of those states with napoleonic laws.
You could go to jail for driving without liability car insurance.

So, what you guys are saying is that I can place the two payday loans that I have on my bill consolidation? Oh, with all my medical bills and my other bills I owe a total of around 5,000.00. And to the person who said that I should get a job and pay my bills. my credit score on experian is 524, I am looking for a credit card with low or no initial fees or yearly fees but I can have a high interest rate because I plan on paying it off each month to build up my credit. does anyone know a card that would be most likley to approve me with this criteria?

I was pre approved for first premier bank card but with all the fees it ended up being 250 – 300 debt before I would even spend a penny on the card. and thats before eve n knowing the balance.

im not looking to go into more debt, Ive been paying off debt I had from 8 years ago, for about a year now on a debt consolidation plan. for some reason it didn’t start showing i was paying current till january, even though I have been paying on the card since july. I contested the charges of being late paying and even called my debt consolidation organization to see what they can do about it. my credit score SHOULD NOT BE AS LOW AS IT IS!

the reason I want the credit card incase you are wondering, is I have to get a rental car and all rentals require a credit card. also we are short about $200 for our vacation because we didn’t budget having to get a rental. we are going to ride down with a friend to san antonio but now she has decided not to take her car. she doesn’t have good credit either. about as good as mine. so I cant have her get a rental.

this is why I cant get a prepaid card right now, I know they build on credit, I would like to get one, but you have to put money upfront and my money is going to be tight until half way through our vacation on the third when my hubbie gets paid.

then well have more than enough to pay off the the credit card

dont want to be condsidering pawning or payday loans because the interest is so high even when you pay on time unlike a credit card

About a month ago I applied for a payday loan from one company online. Several companies contacted me, and one actually deposited money into my account without me knowing it. I didn’t know who did it or how it even got there until 2 weeks later they sent an email and hit me with a $90 finance charge and I could see a name. I’ve called and left them messages, emailed, faxed, and even contacted the BBB with no luck getting in touch with them to plead my case. How can I get this resolved? I need to get out of this by Friday! And if I withdraw all my money and put it in another account, wont that be an NSF on my current account then? Should I only do that if my current bank wont work with me?

This is exactly why a person should never use, or even apply for, an online payday loan.
Close your bank account asap, otherwise they’ll just keep debiting money. Be forewarned, this is going to be a real mess to clean up. Offer to settle this loan for the exact amount that they put into your bank account. Get all terms in writing before you pay, to include a letter on their letterhead stating that the account will be Paid in Full once the agreed to amount is received. Once you get this, send them a USPS money order. Keep the letter and a copy of the money order in your records forever as documentation.

For you reference, never give out your bank account and routing #’s when you apply for any loan.

The two I found want me to have had my checking account for 2 years or more, and they want me to have had my address for 2 years or more.

Yes, there are true payday lenders on the net, but I would advise against using them. The reason you are getting a page that says that the operator of the website is not a lender is because you are most likely entering your info into a page, and it is being directed to whatever payday lenders would be able to work with you and your situation. Those places are more like a headhunter of sorts, they find the loans for you. Getting into the payday loan cycle or trap isn’t a wise decision and maybe it’s a sign from the Universe trying to save you from going down a dark alley with your wallet out and a bunch of thieves looking to jump you.

Payday interest too much….?

I had to take out $2500 in payday loans to pay some emergency medical bills. The interest alone is going to cost me $550 each pay period (twice a month). I know all of the horror stories of taking these out, but I had no one else to get a loan from. I looked up several companies that say they can negotiate with the payday loan lenders, just like when you consolidate credit cards. I was wondering if anyone had ever heard of or knew anyone that had done business with PDL Assistance or Langhorne Debt Solutions. PDL Assistance told me that I could have these paid off in 10 months with a $230/month payment. They will email me the contract and I have to send them the form back that authorizes them to talk to my 3 lenders to negotiate the loans. They will also send me a form to take to my bank that will stop the 3 lenders from withdrawing any further debits from my account. They did not tell me to close my account. Any suggestions?

I wouldn’t use those consolidattors – they’ll ding your credit report and charge high fees.

If you’re really solid financially and can pay it off, I would try to get vetted by prosper.com and see if you can get a small loan to float this off – you may need to do one small loan and pay it off to show that you’re credit worthy.

payday lenders do not report to credit bureaus, big banks can keep you trapped in the turn down cycle, while still making money off you without approving you for a traditional loan, is this not a violation of the ecoa act of 1974?

I have seen many people come into the bank to apply for a loan (auto, consolidation, personal, etc) and when their credit is pulled they have dozens of loans from payday lenders. No lending officer in their right mind would loan money to someone that uses a payday lender as they have proven they can not manage their income properly. Besides the fact, people using payday lenders typically don’t pay bills on time so their credit score is likely lower than average.

So, given the fact the credit score is lower and a payday loan is a derogatory credit note, lenders can deny traditional loans without violating the Equal Credit Opportunity Act.

I have bad credit..Payday loans messed up my bank account. I need money by Monday 5/14/07 help?

I need aloan to pay off my childrens tuition, pay my summer tuition, and reregister my girls for the fall. I have a great job, but had a family crisis( oldest daughter got Lukemia) and I had to pay for treatments til Medicare was approved. I had a few payday loans, payng on time, until one of them went in a day early and tried to get their entire balance. That was not the arrangement, and they messed up my account, which caused a trickle down effect on every other account that was ACHed from that account. Not to mention the bank bounce check fees. I am working on getting those items corrected but now I need $4000. Any idea where I can look…fast. Without this last payment, my daughters will not be able to take finals and they will have to repeat the entire grade. I can verify all I have said. Please no scam artist saying they can give me a loan at 3% knowing they are going to charge me for living in the US and you will never see the money. ( They are on report now)
Did you read the part about the bad credit. I need lenders almost like loan sharks that will lend to anyone, like me with bad, terrible credit. I am considered high risk. I need a lender who will give me a chance despite my credit score.
Let me express something. I have no family, part of my debt comes from the house that was forclosed on when I had my stroke, and I loss everything in it, and the payday loan thing. With that said, it is not that I run up debt, I live in a cheap 1 bedroom so my girls could go to that school, and yes I will take a semester off if I have to. The point is I still have to pay their tuition for this month and register them, or they will loose their spot. They are twins and they were born with problems so I have to keep them in this school or they will fail ( i’ve tried public it was like pre school they are 14.) Can I default on Internet payday loan without wage garnishments & prosecution?

I live in NM & I am on the verge of total financial collapse with payday loans. I am on the verge of being homeless. I read on this forum an previous answer from Badonkadonk & the answer was to close my bank account & to take control of my whole check. I think I cannot be prosecuted in NM. Well, your in a pickle, and no mistake.

One problem is Most banks won’t actually let you just close an account. Most require a 1 month waiting period after you tell them you want to close your account and sign the paperwork. They do this specifically to prevent what your doing-closing an account from which payments may still be owed or sought. But you can try it…

They’ll keep coming after that money…

I’m not sure what you can do at this point, a lot of people have become homeless like this lately…
