is anyone aware of payday loan co. giving your bank info to third parties claiming you authorized debits?
I applied at a payday loan co. and 3 times I ended up with debits from my account. Twice was for $19 for applying but the kicker is when $49.99 was taken from my account for a secret cash card? I found out where it came from and they claim I checked yes to one of the boxes on a payday loan appl. authorizing this third party company to send a check through my bank ordering a secret cash card thats a prepaid debit card thats suppose to give me online privacy when purchasing and protect me from companies and people from getting my personal info. Now it seems like I need that very protection from the stupid people thats selling it or fraudulently debited my account! The bank told me that when I applied for the loan I authorized the third parties to debit my account for various things. My thing is If your applying for ONE thing such as a payday advance how can it’s friend tom who sells shoes, joe who sells dog food and mary who sells secret cash cards legially take that money out my bank ?
Besides if I needed to apply for a payday loan then I didnt have money in the first place for no secret cash card and the funny thing is I never even got the loan!

Can I take legal action against a website that stole my information and sold it?
The other day I was looking at payday loan sites (yes I know terrible idea) and I found one that interested me. I filled out the information they asked for (including my SSN and bank account number) and after I submitted it they immediately told me I didnt qualify. Right after that my inbox got flooded with spam. I get about 300 spam emails a day now. I also keep getting phone calls and texts that are just spam. Somebody also tried to access my bank account but the bank stopped them. I confronted the website via online live chat (their phones “are not currently working”) and they swear up and down they dont spam and that its not from them. It has to be though because I never got spam before that and a majority of the spam was for payday loans. I want to know if there is some kind of legal action I can take against this site. They stole it because it was a loan application. They sold it to a bunch of spam sites so yes, I would consider that stealing. Seeing as they do not provide loans and just spam you, I would consider that stealing.
Wow spammers are so fucking retarded. Im asking if I can take a spammer to court and I get a bunch of spam replies offering me loans. I hate the internet.

A couple of issues…
The website did not steal your information. You typed it in and gave it to them.
Was there anything on the application that stated that your personal information would not be shared with anyone else? Lots of sites will sell or share e-mail lists with other companies, resulting in spam mail.
The violation I see offhand is the attempted entry into your bank account. I do not know how detailed the records are that your bank keeps, such as the address/name of the entity that was trying to access the account. Also bear in mind that you gave the loan site your bank account number. Did you read all the fine print? There may have been wording in there stating that by giving them your account number you were authorizing them to access the account. You need to be very careful about throwing around that information.
I seriously doubt that your computer has been hacked. The issue started after accessing and leaving information on another site, so if anyplace was hacked, it would be the website.

I am a 27 year old who has a great job, yet has found himself in trouble with STUPID payday loans. I have a finance degree and cannot believe i have found myself facing this taboo topic of bankruptcy. Though i make good money, i cannot pay off these loans nor my bills. i feel bankruptcy will enable me to afford the simple things…i.e groceries. i have a meeting next week, i feel its my only choice…yes, my debt is consolidated and thats not helping…and creditors still call my work

I’m sorry that you appear to be yet another victim of the “cash advance cancer”. With the new stricter predatory lending laws in place, protecting consumers the carnage left behind from these “sharks” should cease.
I can not advise whether it would be beneficial for you to pursue bankrupt.
I would recommend that you look into it as only a last resort – remember those laws have changed as well .
Your young enough to make a financial recovery that does not involve having that on your credit record potentially harming you more than a few paid collections that will disappear 3 years earlier that a bankruptcy – a without the stigma.
Meanwhile, I wish you well on your recovery from the shark bite.

Will the bank tell a Payday loan company holding my check about my savings account?
Yeah I was dumb, the checking and savings where never tied together.The payday loan tried to force it open, before the due date of the check, so I closed out the checking account,yes I have to pay them but not thru my savings account? I honestly do not think the bank can legally give your financial information to anyone or place of business without a conscent form signed by you. Unless while applying for the loan you signed an agreement to have your savings withdrawn in the event of nonpayment of the loan. (which I doubt considering it deals with checking accounts and not savings). The only account number the payday loan co has is your checking and you since have closed it. I will tell you that by not paying the loan you have created a big problem for yourself. The payday co has a legalized document signed by you and your promise to pay. It will go to court and it will cost you BIG TIME!!! They then will cease your savings and possibly garnish your wages by holding a judgement against you. This happens every day to many people who end up in the payday loan trap. Be smart and don’t let it go this far. You will end up paying three times the amount of the loan including late fees and court costs. As far as the unknown hidden costs you speak of. When applying for the loan you should have gotten a reciept or paper explaining the costs, interest, and the due date.

Okay, I made some bad decisions and took out a couple payday loans, they are killing my paycheck each month. And, I have some high credit card bills because of my husbands illness. Before he got onto health insurance we were paying for his insulin (expensive) plus we have a 1 and 2 year old in daycare and diapers. So, I just wonder about debt conslidation. has anyone used it…? Does it really work….? Is is a good idea?

I would recommend to speak to a credit counselor. Make sure it’s from a non-profit, accredited place. They could advise you about things like a consolidation loan or if you needed more help like where they will work with your creditors to help you pay off your bills. My friend did it and paid off a lot of debt in something like 3 years. I think it’s a good idea.

okay so currently i am at a stand still financially. its kind of worrying me because i can barley make ends meet and i have no other financial support from anyone else. even financial advice for that matter. the only person i can turn to is my other half, however my other half if currently unemployed so that kind of makes matters a little worse, but its so hard to find him a job, we’ve like put it over 100 applications all over and no luck so far, but heres the thing. here is the question id like to ask and get SERIOUS advice and help with. 80 hours a week at your job? At $9.50/ hour?
You are getting 40 hours of overtime (time and a half).
^ Louisiana has laws on this.
With that kind of income, you should be able to get out of this mess easily.
Work on those pay day loans first.
Then work hard to get car insurance.
I believe Louisina is one of those states with napoleonic laws.
You could go to jail for driving without liability car insurance.

So, what you guys are saying is that I can place the two payday loans that I have on my bill consolidation? Oh, with all my medical bills and my other bills I owe a total of around 5,000.00. And to the person who said that I should get a job and pay my bills. I have a job where I have been employed for serval years I just had got hurt and I was off of work for awhile and couldn’t pay all my bills that’s all. my credit score on experian is 524, I am looking for a credit card with low or no initial fees or yearly fees but I can have a high interest rate because I plan on paying it off each month to build up my credit. does anyone know a card that would be most likley to approve me with this criteria?
I was pre approved for first premier bank card but with all the fees it ended up being 250 – 300 debt before I would even spend a penny on the card. and thats before eve n knowing the balance.
im not looking to go into more debt, Ive been paying off debt I had from 8 years ago, for about a year now on a debt consolidation plan. for some reason it didn’t start showing i was paying current till january, even though I have been paying on the card since july. I contested the charges of being late paying and even called my debt consolidation organization to see what they can do about it. my credit score SHOULD NOT BE AS LOW AS IT IS!
the reason I want the credit card incase you are wondering, is I have to get a rental car and all rentals require a credit card. also we are short about $200 for our vacation because we didn’t budget having to get a rental. we are going to ride down with a friend to san antonio but now she has decided not to take her car. she doesn’t have good credit either. about as good as mine. so I cant have her get a rental.
this is why I cant get a prepaid card right now, I know they build on credit, I would like to get one, but you have to put money upfront and my money is going to be tight until half way through our vacation on the third when my hubbie gets paid.

I’m very puzzled about the different terms when it comes to loans and this is one of them. I know that unsecured loans mean you can borrow money from lenders without collateral but you have to make sure your credit score is high. Am I right? If not, please explain. Any loan which is made without pledging collateral. Home loans are secured by a deed of trust on the home. Car loans are secured by an endorsement on the title naming a lien holder, etc.
Credit scores do not necessarily come into play. You could borrow money from your uncle or a friend without any collateral other than a handshake or a promise.
A guaranteed unsecured loan is an oxymoron. The guarantor is liable in the event that you default and more than likely in a better credit position than you the borrower. That’s why the guarantor is acceptable to the lender.

I’m only asking, is because I’ve been trying so hard to get out of them. I do at one point,. But that’s only by closing my checking account and than settling it by a fraction of the cost. It’s quite aggravating! The interest is so high. You have to take out a payday loan to pay off another one sometimes! You can’t write a check from a savings account. You can only write a check from a checking account. Does he have money in this checking account? Why can’t he just go withdraw the $100?
I seriously doubt the payday loan folks will be able to put him in jail if he doesn’t pay. We don’t have debtor’s prison in the US. Typically the payday loan place already has access to your bank account. Did your friend close that account?
Payday loans are bad. The interest rate is like 600%. If you don’t pay, the collectors are very nasty and don’t mind breaking the rules. The normally require access to your bank account and make you sign an agreement to allow garnishment of your wages if you don’t pay. Thus they don’t bother with credit checks.
You friend needs to pay this off. He needs to find the cash some place other than another loan. Have a garage sale, pawn something, sell blood, collect alum cans, get a second job — pizza delivery has flexible hours and you get tips.

what can I do about unauthorized checking account with drawls form unknown businesses?
I had to get me a payday loan over the internet.Everything seemed fine and I got the loan,but 2 days after the loan money was deposited in my account,”companies” , I don’t even know, started to with draw money, for different things, out of my bank account without my knowledge. At first I thought it was just a mix up in the account number or something like that, but it happen 3 times, always a different company. I did get a refund from one of them,and still waiting on a refund from the others.But the last transaction from one of them left my account with an overdraft fee.
What can I do to stop these actions? without closing my account.
I’m almost afraid to deposit any more money into my account,but yet, I have to pay for the overdraft fees the banks charges me.
Can I contact the BBB and report the Loan company as ” illegit”? or report the companies that withdraw money from my account?
Can I take any legal actions against those companies? if so, how would I go about it?

You can try to take legal action, but they will probably just tell you someone authorized the transactions, and for all you know that’s true. It may not be the loan company, but a dishonest employee. You should definitely close the account. Most banks, though if you file a fraud dispute, are more than happy to forgive fees and change your account number. It protects them and you from further loss when your account has been compromised. File a police report and contact your bank immediately, even for the one you were refunded on. I’ve had it happen before where the company returned the money but put the fraudulent debt into collections. The police report will offer some protection.

I need to know if a payday loan company can legally charge 125% interest without telling you in the agreement?
I borrowed $ 200 from an online lender and the agreement said my total repayment would be $260.
I thought that was a bit steep as is. so I called on the phone and was told that that is the total charges i would be required to pay. now that the loan is repaid they say the $260 was just the finance charge and now I owe another $260. I refuse to pay 520 dollars for a $200 loan. What are my rights? they have my checking account # and the payments have been coming out eletronically.

Your rights and obligations are what you agreed to in the contract. Payday loans are an expensive scam and you are finding out why.
Usually, a lot of the high fees are charged upfront with “origination” fees, “service” fees, “contract” fees and the like. So, they really aren’t lying when they give you a particular interest rate, but you are still obligating yourself to a LOT of money.
You can, and should, complain to your state’s Attorney General and the Federal Trade Comission, but chances are you signed a legal contract so you will still have to pay up to get this to go away.
If you believe a lender has violated the Truth in Lending Act, file a complaint by calling the Federal Trade Commission Consumer Response Center toll-free at 1-877-FTC-HELP (382-4357).

Last year I took out a payday loan for $1,000. Every month I go into the store and pay $140 fee to take out a “new loan” at the same place to cover the $1,000. Generally, their collection efforts will start with telephone calls and dunning letters demanding that you pay the balance of the loan. If the payday loan company refers your accounts to a collection agency, you can usually stop the telephone calls by sending a cease communication demand letter, commonly called a cease and desist notice, to the collection agency. A federal law called the Fair Debt Collections Practices Act (FDCPA) states that third party collectors must stop calling you if you notify them in writing to do so. Several states, such as California and Texas, extend many of the regulations in the FDCPA to cover original creditors as well. To find out more about debt collection laws in your state, visit the Privacy Rights Clearinghouse at http://www.privacyrights.org/fs/fs27plus.htm
You may be in luck. There are eight states whose payday loan regulating statute requires lenders to set up an installment repayment plan if an account reaches the maximum number of rollovers allowed by law and the debtor declares that he/she is unable to pay the balance due. Check out the payday loan information from the Consumer Federation of America at http://www.paydayloaninfo.org where you will be able to read all about these loans and the various state attempts to regulate them. Follow the “state information” link to find out the specific regulations for payday lenders in your state, and if you live in one of the eight states requiring installment payments. Working at a payday loan business bad for future employment?
My friend has fallen on hard times and needs a job. He has great qualification and has been offered a GM position at a payday loan company. He doesn’t like it too much ethically but he can stand it for a year or so.
Business is booming at these places as you can imagine and he will be very well trained. Plus, his store will be located in a higher income area so many of the customers will be using western union, small business owners needing to cash a check fast, and things like that.
Will working as a branch manager look bad to future employers? I know that many think it’s predatory lending but he doesn’t set the prices, he just works there. Will this screw him in the end?
