A man called me saying that I did not pay a payday loan and legal action was going to be taken against me…?
A man called me from an unknown number. I did not answer, because I don’t answer unknown or blocked numbers ever. He called twice then left a message. He said that he was looking for [my name] concerning a sensitive matter that he could not disclose on my voicemail. He then left his number which was (646)525-4064 and said that if I did not call back, he would assume that I was trying to escape the law and this could put me in a “big mess”! It sounded suspicious but I did call back anyway.
When I got on the phone, he told me that I had been named the prime suspect in some case involving social security numbers. Oh, he was foreign so I couldn’t even understand everything he was saying so I would have to ask him to repeat it. Then he said something about Big Payday loan filed a suit against me because I had not paid a loan back that I took from them. Last year, I did take out quite a few payday loans, but my credit union helped me pay all ELEVEN of them off and I haven’t heard from anyone since then. He said they had emailed me but I had not responded back. I am trying to run far far away from payday loans because they almost destroyed me, but I never took out any loans with this company. When I do receive emails, I usually unsubscribe so they don’t mail me anymore or send them to spam. I searched my emails to make sure and saw their name a few times where they sent an email for me to take out a loan, but they were just generic emails to attempt to get me to take out a loan. Nothing else.
Anyways, the man said that he worked with legal consulting company to help rectify this situation before legal action is taking. He said the name of the company, but I can’t remember it for the life of me. I also did a reverse phone number lookup and it was a cell phone number out of New York. But anyway, I ended up cutting him off and telling him I don’t owe any more loans, thank you, and hung up. He then called me back twice. I didn’t answer anymore and he left me two messages. The first message said something to the effect that the cops were coming unless I attempted to pay my debt. The second one just said something about call him back so we can discuss my options.
My question is…is this some kind of scam going around? And can I report this character? Also, if I truly still owed a payday loan, wouldn’t the company do more than try to send me emails? Wouldn’t they try to call me and tell me? I’m not scared or anything. This is just crazy to me so I just wanted to ask questions concerning this issue so maybe someone can help me. I am not calling him back. I’m thinking the payday loan companies are mad, because I paid off my debts and not requesting any more money neither am I responding to them anymore…I don’t really know what’s going on….
Anybody with any insight, please let me know….

Ok, I applied for a few payday loans awhile back, but never actually got one. I never signed any agreement or whatever. Today I get 12 messages on my answeing maching from some guy in california (i live in vermont). He told me that I now have a lawsuit against me because I took out a payday loan, and never paid it, but i never had a payday loan!! Then he said I am going to be supenad (sp?) into court, a court in california, and if i dont show up i will be arrested. I dont get it? How can i have charges for a loan I never even had, or signed for? How can they make me go to court in california, when i live in vermont. Finally, since I am pretty sure this is some sort of scam or something, who should I call to report these jerks? I live in Vermont thanks
I did ask for proof, and the guy said “you’ll get your copies in court”, and i know i didnt have a payday loan, i did apply for a few, but never was apporved, or went through with it..but they keep calling like every 15 mins, is there anyone i can call to report them? to make this stop?

Someone may have got your information somehow and applied for a loan in your name. However, seeing that payday loan companies require an active checking account to secure the loan, I think you are safe. Check your account to make sure that no automatic debits have been placed. If none have, then don’t worry about it. It is illegal for any debt collector to threaten someone in any way whatsoever, especially with jail. And no, you cannot go to jail or be arrested for debt. Debtor jails used to be quite common, but they are illegal now. For more information on your rights, go to http://www.fair-debt-collection.com/
The next time they call, get the caller’s name and the agency they represent. Google the phone number. You would be surprised what information this brings up. Contact your state attorney general’s office with your complaint and the above information.

I’ve tried alot of these speedy loans and bad credit loans and citibank and am coming up with nothing. I don’t want to have to pay for anymore loanfinders and I’ve even ran into a scam or two. Somebody please give me some advice. And no payday loans either! Please!

It sounds like your credit is just too poor to qualify for loans. Instead of looking for a loan, you should figure out other ways to come up with cash. Have a garage sale, get a second job.
Make yourself a strict budget and live within your means.

A “law office” contacted me about a payday loan (that I forgot about). They said they are with Mark Goldberg?
They said the outstanding loan was sold to a broker because it was an unpaid debt. It is for $300.00. I am willing to pay it but, I am hesitant because they are asking me to deposit the money into the law offices account via Bank of america. The gentleman sent me a letter of agreement via email. I asked him if he could send the letter to me via mail which he said he would. He could not tell me which loan place the loan originated from (I only know one payday loan place it is) which i contacted and they said the account was sold to a broker. Should I pay the debt or does it sound like scam? I have already had this happen once.

Ask for the documents that assigned the claim to the current holder. He or the claim holder should have a copy on file.
This is a reasonable request to make sure that you are not being scammed. The assignment documents should clearly reflect the chain of custody.

Help with my payday loan!?
Last year I took out a payday loan for $1,000. Every month I go into the store and pay $140 fee to take out a “new loan” at the same place to cover the $1,000. Technically I would already have it paid off by now and then some. I don’ t know if this is considered a “roll over” loan, but I was doing some research and I know they are illegal in Ohio. Can someone please give me some advice?

What type of jobs are available for people who have a high school diploma?
I plan on going back to school in Janurary but I have had terrible luck looking for a job and I am a single mother of a 2 year old and I was wondering what types of jobs are available to me!! Can I borrow loads of money and move abroad?
If I were to borrow £50,000, 20k from an unsecured loan, 15k from credit cards and the rest from payday loan companies, store cards and bank overdrafts and left the country what would happen? Would I get away with it providing I did not come back to the UK for at least 6 years. As far as I know there is no law against not paying back your debts. Thanks for your answers in advance.

If you default on your payday loans, the lender can take the same action as any other unsecured creditor to enforce a defaulted debt. Generally, their collection efforts will start with telephone calls and dunning letters demanding that you pay the balance of the loan. If the payday loan company refers your accounts to a collection agency, you can usually stop the telephone calls by sending a cease communication demand letter, commonly called a cease and desist notice, to the collection agency. A federal law called the Fair Debt Collections Practices Act (FDCPA) states that third party collectors must stop calling you if you notify them in writing to do so. Several states, such as California and Texas, extend many of the regulations in the FDCPA to cover original creditors as well. To find out more about debt collection laws in your state, visit the Privacy Rights Clearinghouse at http://www.privacyrights.org/fs/fs27plus.htm
You may be in luck. There are eight states whose payday loan regulating statute requires lenders to set up an installment repayment plan if an account reaches the maximum number of rollovers allowed by law and the debtor declares that he/she is unable to pay the balance due. Working at a payday loan business bad for future employment?
My friend has fallen on hard times and needs a job. He has great qualification and has been offered a GM position at a payday loan company. He doesn’t like it too much ethically but he can stand it for a year or so.
Business is booming at these places as you can imagine and he will be very well trained. Plus, his store will be located in a higher income area so many of the customers will be using western union, small business owners needing to cash a check fast, and things like that.
Will working as a branch manager look bad to future employers? I know that many think it’s predatory lending but he doesn’t set the prices, he just works there. Will this screw him in the end?

I think most employers will consider your friends personal work ethic, experience, and knowledge of the position they are hiring him for, and not judge him because of the company he worked for. Instead of looking at the ethical issues regarding payday lending, your friend should focus on what he will learn and gain from working with this company.

I’m in over my head in payday loans and Yes! I do know it’s a bad thing, problem is I need help and am looking to consolidate my bills and roll them into it. I know the bills on my credit will affect my credit, but will my payday loans show up? Do you recommend any companies?

You payday loans probably are not showing on your credit file. You can get a copy of your credit report and check (AnnualCreditReport.com).
However, if you had to resort to payday loans to begin with, you are probably going to have trouble finding a lender to give you a loan big enough to pay off those loans. The interest will be high but no where near as bad as that 600% range of payday loans.

Does anyone know what the laws on payday loans in Utah are? What are the consumers rights?
I recently went back to school and got some payday loans to help buy books and things now I am in a pickle and am wondering if I have any rights as the consumer…HELP

Most states have abolished ‘payday’ loan companies, so I’m somewhat surprised that Utah still allows them. Anyway, what you really want to know is this: do the Utah state ‘usury’ laws apply to me when I applied for a ‘payday’ loan. Yes, because Utah obviously allows these establishments the rights to do business, you are protected by usury laws; however, I suspect somewhere in the storefront you entered for this loan, you will find ((I suspect inconspicuously) a frame advising all clients of their rights. Usuary laws protect state residents by establishing a ‘cap’ on what payday loan companies can charge as interest. You might want to do an internet search for utah’s usury laws. There you will get the answer you’re looking for.

How to get help with Payday Loans Las Vegas?
I have payday loans, but I don’t have the money to pay them back due to recession. Is there any payment plans for customers?
Will they put me in jail or take me to court? Or will this just go on my credit report?

1. Tell the lender that you need to work out arrangements to repay in installments. A few states require lenders to provide extended payment plans (Alabama, Alaska, Florida, Illinois, Michigan, Nevada, Oklahoma and Washington). If your lender refuses to work with you, contact your state regulator to ask for help.
2. Stop lenders from taking money directly from your paycheck. Read your contract to see if you signed a voluntary wage assignment clause. If so, write a letter to the lender to revoke that agreement so the lender won’t be able to garnish your pay from your employer without court approval. Mandatory wage assignments as used in some payday loan contracts are prohibited by the Federal Trade Commission‘s Credit Practices Rule.

I made a huge mistake in using payday loans to help pay bills during a rough time. Now I can’t get from under them and it’s hard to pay on my regular bills. My credit is 495 therefore it has been hard to get a loan.
Is there help for me? Once i can get these loans paid I can make the monthly pay’ts.

Yuck…payday loans stink. There’s a reason they’re popping up all over in lower income areas—they’re very profitable.
I’m sure there are loans that you could use to consolidate. I would try to get a 0% APR credit card, but you’ll have trouble with your marginal credit score–just like with any other loan.
You should consider selling assets–car, junk on ebay, etc to pay this thing off ASAP.

Can I be arrested for defaulting on some payday loans? What kind of trouble can I be in?
I currently have 3 outstanding payday loans(in store services). I got into a jam and I have an outstanding balance on all 3. I partially paid back one but they keep debiting my account and I keep getting penalized from my bank for all types of fees. I also know the interest is racking up on all 3 loans. All the loans are less than $1000 and one is below $500. I am doing my best to make the money to pay them back along with all the fees but right now I am just having some tough times. What kind of trouble am I in here? Can I be arrested for this? I know this was one of the dumbest things I have ever done and I will never deal with any payday loan companies again once I take care of this. First things first…you signed the contract when obtaining the loans…this is a legal and binding contract. If the payday loan company wants to turn you into the District Attorney’s office, of course they can and they will arrest since this is passing a bad check. Most of the time though, you are taken to court, sued, and they are granted a judgement and from there granted a garnishment against you paycheck, or bank accounts up to 100%, also placing liens on any property if you own any…..The best advice, try and set up payment arrangement to get them paid off, borrow from a friend or relative, but, if they process to sue and you get a court date, show up…you can set up a payment arrangement with the judge to get the payments made and not have it taken from your wages, or bank account. Poor Credit – Where can I turn for a semi-reasonable interest rate (< 100% APR) on an unsecured loan?
I have about $2,500 in debt. about $1,400 of that is to payday loan stores which are charging me through the nose in interest. I’m paying around $500 a month in interest. I could probably pay everything off and be debt free in 6-8 months if I could just get a reasonable interest rate. The problem is that my credit sucks and I don’t own anything that could be used as collateral. Are there any banks or other lenders who might give me a loan at a rate less than 100% apr?
Do you have any other suggestions to get out this mess?

That is the trap of payday loans and why I always suggest staying away from them. Well to late for that, so the only thing you can do is bite the bullit, pay them off and deal with the consequences if not it will never end. You will not get a loan to get you out of it, so even if it takes all other bills will be behind it is easier to get caught up on those, get rid of those loans and out of their stealing you life which is what they do.

Payday Loan would not accept check?
My bank changed hands recently and everybody was sent new credit/debit cards. We were told to continue using our old checks as usual. I had a payday loan out w/Advance America and was told by the store that they could not accept my checks anymore due to the bank changing hands. The store manager asked me to bring back counter checks or some other check that had the new banks name on it. The branch Mgr clld the store and was given the same run around w/no explaniations or name of the person Advance spoke w/at the bank. Has anyone else gone through this w/Advance America?
Keep in mind we were advised to continue using out old checks, the bank is not issueing new checks! So taking the money out and paying it off is not answering my questions. As asked please let me know if anyone else has had this problem. Thanks!

You have a new debit card, so how about withdrawing the money at an ATM and repaying your payday loan in cash? If you don’t use checks until the new ones are issued, you won’t have this problem.

Do you have any insights about borrowing from PayDay Loan lenders like Money Mart? There’s really nobody (family, friends) who could lend me the amount so I gues Money Mart is my last resort..

Don’t get into debt to pay off other debts, write to who you owe the money to and make an arrangement, much better in long run. Borrowing more money will just escalate your problem. Trust me I have leaned from experience while running up a £15k debt

Can I be held responsible for a payday loan I never signed for?
My information was apparently given out when I was on a web site which said it would match me with a lender. A company called Ace Cash Services deposited 300 in our account without us ever asking them for a loan or signing anything. They now say I owe them 510! I told them I would be more than happy to give them the 300 but no more. What are my legal rights?

If you did not want the loan then clearly you should have given out your checking account/bank transit number. The bad thing here is that these people have everything they need to start debiting money from your checking account…even if the money is not there. You’re going to have to pay them $510….sorry. It’s safe to assume that if you don’t make your own payment arrangements, then expect them to try to debit $510 from your checking account within 2 days.
If the money is not there, then you need to close your checking account…otherwise your account will go hundreds of dollars into a negative balance and you’ll have another separate problem to deal with.
Offer to settle the loan for $400 and see what they say…get a signed agreement to these terms FIRST, then send a money order for this amount. If you do nothing, then in about 3 months you can expect the amount you owe to skyrocket to over $2,000.

Looking for info/ reliable source of high risk lenders..no payday please?
I am searching for all of those alleged high risk lenders that are willing to lend money for those with credit scores in the low 500′s. I am not interested in payday advances. My wife took a $10,000 a year net pay cut this year and we are struggling to keep it together. We had a little girl last year and my wife was out for 7 months. We are still paying off medical bills.
We have consolidated all of our debt and credit cards and cut them up. I am so through with CC. We are too comfortable using them. We restructured our finances and eliminated the fluff. Now we are down to the house, car, food, electric. I need help to pay off 4 payday loan companies I had to turn to during my worst months this year just to keep the lights on. I will thank those in advance who will say…live simply and things will get better…I work 60+ hours a day and between the two of us we bring home more than 7.5 K monthly…the payday loans will not let us get back on track. My family is not able to help much.

Are there really people out there that will loan money?
I’m not talking banks, or payday loan places, I am talking legit private lenders that will loan you money? You hear about private lenders that will lend money, but I can’t seem to find anything legit or worthwhile. A 100-500 dollar loan is not worthwhile and it’s not legit if you have to PAY to get your loan.
Has anyone had any success with finding what it is I am looking for?
This is serious, so please no bashing.

Yes, I actually do what it is you’re speaking of. Not small loans, but loans between 10-100k+. It’s quite an interesting process which centers around what you offer for collateral.
For example, if you have a home worth 100k and have it paid off, or even mostly, it’s pretty easy to get a loan, even with very poor credit. If you have a business, and are struggling to get a loan, if you have assets (equipment, accounts receivable, contracts, real estate, etc), there are people who specialize in loans on business assets.
Expect to pay a high interest rate and sometimes a high origination fee.
