Helen asks…
Help with my payday loan!?
Last year I took out a payday loan for $1,000. Every month I go into the store and pay $140 fee to take out a “new loan” at the same place to cover the $1,000. Technically I would already have it paid off by now and then some. I don’ t know if this is considered a “roll over” loan, but I was doing some research and I know they are illegal in Ohio. Can someone please give me some advice?

Loans Guide answers:
Let me get this straight — you borrowed at about the highest price legal place to do so and now you want to rescind the deal without paying the fees you agreed to??
What odes the Ohio AG says about the legality of this firm? Dollars to donut holes, he says its perfectly legal and you owe.
***
CUT your spending and pay off the ding thing, even if its only an extra $100 every other month.

Donna asks…
What type of jobs are available for people who have a high school diploma?
I plan on going back to school in Janurary but I have had terrible luck looking for a job and I am a single mother of a 2 year old and I was wondering what types of jobs are available to me!! I have 3 years customer service and 3 months of Store Management experiance at a payday loan store but no one seems to be hiring!!!

Loans Guide answers:
I think the best places to look r in the retail stores. U seem to have great work experience and someone will hire u if u just keep at it.

William asks…
Can I borrow loads of money and move abroad?
If I were to borrow £50,000, 20k from an unsecured loan, 15k from credit cards and the rest from payday loan companies, store cards and bank overdrafts and left the country what would happen? Would I get away with it providing I did not come back to the UK for at least 6 years. As far as I know there is no law against not paying back your debts. Thanks for your answers in advance.

Loans Guide answers:
Your scheme as you describe it is fraud, not uncontrollable debt. For that, they can throw you in fail. If the prison you end up in has internet access, please keep us informed as to how your scheme worked out.

Sandra asks…
I need to get out of payday loans!!! Help !!!!!?
I have a few store front payday loans, not the online kind. Is there any way to get out of them legally?? Also does anyone know of a way for a person with bad credit to get a loan that does not have a super high interest rate?? Thanks in advance!!!!

Loans Guide answers:
If you default on your payday loans, the lender can take the same action as any other unsecured creditor to enforce a defaulted debt. Generally, their collection efforts will start with telephone calls and dunning letters demanding that you pay the balance of the loan. If the payday loan company refers your accounts to a collection agency, you can usually stop the telephone calls by sending a cease communication demand letter, commonly called a cease and desist notice, to the collection agency. A federal law called the Fair Debt Collections Practices Act (FDCPA) states that third party collectors must stop calling you if you notify them in writing to do so. Several states, such as California and Texas, extend many of the regulations in the FDCPA to cover original creditors as well. To find out more about debt collection laws in your state, visit the Privacy Rights Clearinghouse at http://www.privacyrights.org/fs/fs27plus.htm
You may be in luck. There are eight states whose payday loan regulating statute requires lenders to set up an installment repayment plan if an account reaches the maximum number of rollovers allowed by law and the debtor declares that he/she is unable to pay the balance due. Check out the payday loan information from the Consumer Federation of America at http://www.paydayloaninfo.org where you will be able to read all about these loans and the various state attempts to regulate them. Follow the “state information” link to find out the specific regulations for payday lenders in your state, and if you live in one of the eight states requiring installment payments. If your state does require repayment plans, and the lender still won’t accept payments, call your state regulator of payday loans, usually an assistant Attorney General, and complain. You should get the results you want after the Attorney General’s office becomes involved.
If you are not in one of those states, you may want to consider simply making payments to the lender anyway to pay down the balance of the loan over time. In most states, the rollover limit will soon be reached, and the interest rate the lender can charge will be capped by state law. If the lender will not accept your payments, simply put what you can afford aside until you have enough money to either payoff the loan or to offer a settlement. Read up on the regulations in your state to find the best strategy for your situation. For more information on state law terms, please visit http://public.findlaw.com/

Richard asks…
Working at a payday loan business bad for future employment?
My friend has fallen on hard times and needs a job. He has great qualification and has been offered a GM position at a payday loan company. He doesn’t like it too much ethically but he can stand it for a year or so.
Business is booming at these places as you can imagine and he will be very well trained. Plus, his store will be located in a higher income area so many of the customers will be using western union, small business owners needing to cash a check fast, and things like that.
Will working as a branch manager look bad to future employers? I know that many think it’s predatory lending but he doesn’t set the prices, he just works there. Will this screw him in the end?
Thank You,
TJ

Loans Guide answers:
I think most employers will consider your friends personal work ethic, experience, and knowledge of the position they are hiring him for, and not judge him because of the company he worked for. Instead of looking at the ethical issues regarding payday lending, your friend should focus on what he will learn and gain from working with this company.

Yes. You owe them the money, and if you don’t repay it they will take you to court.

Nancy asks…
can i get an loan online (check into cash) and then pay it back at local store?
i want to take out 3 loan from 3 different payday loan companies, online would be quicker and i hear its cheaper, can i take out 3 payday loans online and then pay them at the local payday companies?

Loans Guide answers:
No. All you will get online is scammers

Joseph asks…
Can I be arrested for defaulting on some payday loans? What kind of trouble can I be in?
I currently have 3 outstanding payday loans(in store services). I got into a jam and I have an outstanding balance on all 3. I partially paid back one but they keep debiting my account and I keep getting penalized from my bank for all types of fees. I also know the interest is racking up on all 3 loans. All the loans are less than $1000 and one is below $500. I am doing my best to make the money to pay them back along with all the fees but right now I am just having some tough times. What kind of trouble am I in here? Can I be arrested for this? I know this was one of the dumbest things I have ever done and I will never deal with any payday loan companies again once I take care of this. No sarcastic answers please we all go through hard times.

Loans Guide answers:
First things first…you signed the contract when obtaining the loans…this is a legal and binding contract. If the payday loan company wants to turn you into the District Attorney’s office, of course they can and they will arrest since this is passing a bad check. Most of the time though, you are taken to court, sued, and they are granted a judgement and from there granted a garnishment against you paycheck, or bank accounts up to 100%, also placing liens on any property if you own any…..The best advice, try and set up payment arrangement to get them paid off, borrow from a friend or relative, but, if they process to sue and you get a court date, show up…you can set up a payment arrangement with the judge to get the payments made and not have it taken from your wages, or bank account. Good Luck!

Mandy asks…
Poor Credit – Where can I turn for a semi-reasonable interest rate (< 100% APR) on an unsecured loan?
I have about $2,500 in debt. about $1,400 of that is to payday loan stores which are charging me through the nose in interest. I’m paying around $500 a month in interest. I could probably pay everything off and be debt free in 6-8 months if I could just get a reasonable interest rate. The problem is that my credit sucks and I don’t own anything that could be used as collateral. Are there any banks or other lenders who might give me a loan at a rate less than 100% apr?
Do you have any other suggestions to get out this mess?

Loans Guide answers:
That is the trap of payday loans and why I always suggest staying away from them. Well to late for that, so the only thing you can do is bite the bullit, pay them off and deal with the consequences if not it will never end. You will not get a loan to get you out of it, so even if it takes all other bills will be behind it is easier to get caught up on those, get rid of those loans and out of their stealing you life which is what they do.

Michael asks…
Payday Loan would not accept check?
My bank changed hands recently and everybody was sent new credit/debit cards. We were told to continue using our old checks as usual. I had a payday loan out w/Advance America and was told by the store that they could not accept my checks anymore due to the bank changing hands. The store manager asked me to bring back counter checks or some other check that had the new banks name on it. The branch Mgr clld the store and was given the same run around w/no explaniations or name of the person Advance spoke w/at the bank. Has anyone else gone through this w/Advance America?
Keep in mind we were advised to continue using out old checks, the bank is not issueing new checks! So taking the money out and paying it off is not answering my questions. As asked please let me know if anyone else has had this problem. Thanks!
OMGosh, I”m not looking to take out a new loan, I’m asking if anyone experienced this same situtation where the bank changed hands and a vendor would not accept your check that per your bank was advised to cont using? I’m looking for a new loan!! Has anyone had this problem w/thier bank or a vendor?

Loans Guide answers:
You have a new debit card, so how about withdrawing the money at an ATM and repaying your payday loan in cash? If you don’t use checks until the new ones are issued, you won’t have this problem.

Maria asks…
Opening check cashing store and I want to create to your needs please help!?
Hi everyone! Please respond with your views on check cashing stores, payday loans, etc… Include what you like/dislike and any suggestions. Please help me make my store #1.

Loans Guide answers:
You need a STATE LICENSE to run such a business. Please check with the “banking” authorities in your state capital to find out what else you need. Offer more services than just advances and check cashing, such as phone cards, money orders to pay bills, stamps, and copies of letters or documents at reasonable fees.
I have managed such a store in Northwest Ohio, and there are rules and procedures you must follow before you can open such a business. This includes having access to a significant amount of cash before you ever open, and insurance that is quite expensive.
Contact me at my e-mail, The_Judge_Mobile@Yahoo.Com for more detailed information.

Sharon asks…
What happens when you have a PayDay loan?
Direct deposited but you have to close that account due to future fraudulent charges.
I have to close the checking account that I used for 2 of my loans (which they take the money out automatically on the due date.) 1 company is only on the internet so it’s not like I can go inside the store and pay

Loans Guide answers:
Besides paying interest in the 600%+ range, payday loan companies can be a problem even after you’ve paid them off. I would strongly recommend that you close any bank account that you allowed them direct access to. There are all sorts of horror tales of payday loan companies taking funds a couple years after the loan was paid in full.
You may also want to rethink using payday loans. The interest rate is so high, it’s just a sink hole. You might be better off paying late fees on some of your bills than taking out payday loans.

Daniel asks…
any lawyers familier with the payday loan laws that just went in effect in July for Oregon?
my question is i been paying off a payday loan from the cash store through a 3rd party collection agency for about 9 months at 100 dollars a month then I fine out that in early August my account was sent back to “The Cash store” I noticed it was the same time frame that alot of the companies in Oregon gave up there license to do business in Oregon cause of the new laws that went in effect in Oregon on July 1st. Now I cant get a hold of anyone from the company to ask whats going on. I owed 435 dollars lefted of about a 1000 dollar original balance. Do you think they just charged off the remaining balance?

Loans Guide answers:
Y think no.
I’ve had good results here…

How do I market while in the office?
I work at a payday loan store and have been unable to get outside to market anything because of having no manager right now. How do I get new customers in without leaving the office?

Loans Guide answers:
Is that your job? PDL is rich; let their HQ marketing dept take care of that!

Thomas asks…
Payday loan company charging too much?
I recently got a payday loan from a place called “The Cash Store”
My loan was for 100.00 – the amount I paid back was 147.00. Is there somewhere I can report them there was a brokerage fee of 28.00 and also a fee of 8.00 for a debit card – as this company does not give out cash and gives loans on debit cards instead
I’ve heard of someone reporting a pay day company before and getting the whole amount (even what was borrowed back)
Even so, these jerks should be reported for taking advantage of people who are in a tight spot financially
Thanks

Loans Guide answers:
There have been many law suites against them.
They outlawed them here in Ga. I heard of talks of trying to get it back.
But that is the whole reason the government is mad is people paying the highest interest rate their is.
Try the web site I love it is called Prosper. It is where people loan people money. And the sooner that you pay off the less interest you pay.It has been on CBS news.

George asks…
payday loan without a checking or savings account?

Loans Guide answers:
The #1 requirement for a payday loan is a job. Technically, a payday loan is a loan that you pay back the next time you get paid.
Zero internet lenders will give you a payday loan without a bank account b/c this is there only way that they can receive payment. There are brick and mortar payday loan stores that will give you what they call a “signature loan” in states where they can garnish your wages. They do this through a voluntary wage assignment that you sign or a court ordered wage garnishment, if they sue you. I’ve seen this product in Illinois and Wisconsin because we run a payday loan software company. I don’t know what other states this will work.
Again, you’re question was “Can I”? You can get a payday loan without a checking account in certain states. You probably shouldn’t b/c this product typically costs twice as much as a payday loan. Just by opening a checking account, you cut the cost in half and by having $500-1,000 in your savings, you don’t ever have to take out a payday loan, period.

Susan asks…
Does anyone know of a website that offers payday loans without bank account or credit check? Oh, and same day?
I live in Texas, I don’t know if that matters.

Loans Guide answers:
The site below will explain the risks, as well as at least a half dozen places that offer what you are looking for. If you are resposible and only need the money for VERY short term needs, then these places offer a great resource.
Best of luck to you.

Joseph asks…
payday loans without a bank account?
i need a loan but do not have a checking or savings account any suggestions?

Loans Guide answers:
Don’t get the payday loan. It’s a rip off. The interest rate is HIGH. They may not give you the loan with out an account. When it’s time to pay the loan back they want to debit their money directly from your account.

Helen asks…
my checking account is constantly in the red. how can i pay all my bills without overdrafting?
before i even get my pay check, i owe the bank anywhere from $100-$300, so by the time i get what’s left over and pay bills,i need more money just to get by for the next two weeks, so i end up applying for advanced payday loans. its a never ending cycle that i need a way to get up and out of. please any advice?

Loans Guide answers:
You need to budget your money better, write down EVERYTHING you spend. Even if its 25 cents on a pack of gum. Everything goes into the log, that way you see what you are spending. Go without luxury satellite or cable, cut back on your phone plan.

Ruth asks…
Does anyone know where to get a payday loan without having a bank account? ?
Is there any sites that send checks instead of wiring money directly to your bank account? I need a payday loan. I know all the bad things about these places and how much interest they charge so please do not leave any feedback regarding that cause i’m well aware. Any info as to where i can get a loan without giving out my bank account would be helpful. Thanks so much.
I can’t get any credit cards, my credit is too bad. No one will approve me

Loans Guide answers:
Can’t be done.
The problem with not having an account is not that they have nowhere to deposit the funds; it’s because the lender uses your check or draft authorization to collateralize the loan.

Thomas asks…
when a lender tells you that you need a voided personal check to get a payday loan how do you get it?
I have never had a payday loan before and I was wondering do I go by a check from the store and write void on it or do I have to stamp it or what do i have to do because I have no Idea.

Loans Guide answers:
You have to have a checking account in order to get a payday loan, so you would just write “Void” across one of your checks and present it to them.

Payday loan question…?

i know i shouldnt be doing these in the first place but its an emergency. So will i be able to get it from the store even if i have one out from online. They are from different places.

Loans Guide answers:
How much money do you really need? You could do a cash advance and then pay it off when you get paid.
Don’t go to payday loans. Just get it off your credit card and then pay it off later on.

Mark asks…
Texas payday loan didnt get paid, now getting calls from Federal Attorneys office in California. so they say?
So I took out a $950 payday loan and made 2 or 3 payments on it and get it down to like $700. They made me write a post dated check, which I ended up having to close the account because there was fraud on the account. I was out of town, and completly forgot to let the loan store know. IM back in town and getting calls from an indian guy that tells me that he is with the Federal Regulators attorneys office in California and that 3 criminal charges are being filed on me for stealing and 2 others that i cant remember because i was unable to udnerstand the guy. I ask for an address that Im unable to find on google maps or any federal site. I call back to verify the charges and they then tell me they are a different company name with a different address that i am still unable to find. Now my question is, can any of this really happen? I know I can be sued in civil court, fine, but any criminal charges? I know bad check writing is illegal, but i cant predict fraud and the bank making me close my account. any help will be appreciated. my attorney’s office isnt open on the weekend, otherwise i would ask him.

Loans Guide answers:
Well, there is no “Federal Regulators attorney’s” office, so that is fake — the guy who is calling you is probably just a debt collector, not a law enforcement official. You can, however, be charged criminally for writing bad checks. But you would be charged by a local district attorney, not a federal official.
