What can i do about a company harassing me about a payday loan?

Im being harassed by this company in Florida saying that they have a lawsuit against me because i refuse to pay off a payday loan. I also received a previous call from this number saying that i had a warrant out for my arrest and that they were sending police to my house. When speaking with this company I told them that i did pay it off and they said the money they collected from my account was not going towards the payoff but it was fees. The loan amount was for $200 and i gave them well over $300 before i closed the bank account because of this issue. Later to find out that these loans are illegal in my state. So do they have a case against me or is it just a scam? Im not so much worried about them threatening me with the lawsuit but the fact that they have all my personal information including my ssn and what they can do with it.
i dont have a mailing address or email of the company, just the phone number

You can’t be arrested for failure to pay a debt. They would have to sue you to collect what you owe.

If you want them to stop calling you, copy and paste this text (with the appropriate parts changed to match your case) into a letter to them and they will not be allowed to make further contact or they can be fined.

I want to find how to contact Total Lending Payday Loan, either an e-mail address or 800 #.?

I have a payday loan I want to pay off with this company and I can’t find the address for them and they just keep taking cash from my checking acct. every 2 weeks and don’t e-mail or call me to make arrangements for a pay-down or pay-off, which I know is a scam and that is why I want to get them paid off and their hands out of my cash… Thanks for any information anyone has on this company. I expect there is at least one more “name” this company hides under so it is hard for someone like myself to find them on a web site, so if anyone knows other names please let me know, I REALLY want to get this issue resolved quickly…. I am in the same prediciment as you. I also have a loan with this company. But, I might be able to help. This morning I found what I believe is their fax#. I had the name Elisa written next to it and I do remember she is the person who helped me with my loan. So, you can try faxing them a note at this number and telling them you want to pay off your loan or ask them to contact you. I hope this helps. When taking out these pay day loans it is best to keep the paper work you sign and fax to them because it usually has the phone number on it. I accidentally lost my paper work but I did at least have this fax number written down. 1-866-379-7667

what can i do if a payday loan company is taking money from me without me authorizing it. it seems like a scam?

The problem is, they have been deducting $90 every two weeks from my account and I had no info about this company. I finally found some on-line the company name is magnum Z LLC and when i spoke to the one guy over the phone he said i authorized it. kept stumbling on his words and when i asked for a voice record of me authorizing it he said no and i asked why he said cause he said so. he said he would report me to collections and i really don’t want that to happen. I paid them more than the loan amount was which was for $300 and they still are taking money out. they said that the $90 are finance charges and that I needed to call to pay down the loan so none of the $90 went to the principal in other words. I don’t know what to do. Help please.

First you need to contact your bank and tell them that someone is debiting money from your account that you didn’t authorize. They’ll make you complete some forms stating that the charges were fraudulent and you’re disputing them etc. You also need to write the company a letter asking for proof of the loan, any finance charges and pay off amounts to date. If they cannot or will not provide that information, I would tell them that I was contacting my attorney and filing a claim with the Better Business Bureau.

You may have to go as far as closing your account and opening a new one to stop them for automatically debiting the money. It’s a painful process but it might be the best thing to do because:

1. They cant take your money anymore
2. They would be forced to send you a letter or contact you regarding what you owe (because the eft would bounce back to them)
3. It wouldn’t affect your credit because the payments would return to the company as a closed account (you have proof of fraudulent activity) and not NSF

Don’t let it go on for too long otherwise it will look like you agreed to the charges.

Call from a foreigner about a payday loan?

I have 2 current payday loans and I am making my payments on them. However, I am receiving a lot of calls from this foreign speaking person and he is arguing with me that I owe them and I don’t. I don’t know where he got my information from, but I am paying on my two loans like that I am supposed to be. He says that he is an investigator and he is calling from somewhere in California. I have tried to tell him that I don’t know anything about his company and he starts arguing with me and I cannot get a word in when he is rattling on and on. I told him to contact my family attorney and he says that he can’t do that. He said that if I don’t straighten it out that he will have to turn it over to my local sheriff’s office. So, I told him to go on and do that. I am tired of messing with him. I believe he is running some type of a scam. Has anyone else had this happen to them?

Do not talk to this person – if he calls again tell him that you are demanding that he cease all contact by phone and that he can only communicate with you through mail

This is a scam – if you are paying on time then a scammer might have hacked your loan company‘s database

Never get in conversations with these people – tell him to put it in writing and tell him the call is being recorded as the other poster says. If you feel you are being threatened or extorted for money, file a police report for harassment

Anyone know how to get out of payday loan hell in illinois?

Sarcastic, rude, and snotty comments need not be left. In this economy people, I recently being one of them have no choice but to turn to all means needed to get by. Up until 2009 I was living well, my husband however is now because he is a union worker in a construction field isn’t working. I also since 2008 have taken over a $8000 cut in my pay, so while we have cut back it seems like it just isn’t getting better. I made a huge error in getting a payday loan, something I’ve said I never did. They are vicous, found my self having to get another just so as I could pay the interest. So now I have 3! I pay $35, $75, and $55 a paycheck (every 2 weeks) But I can’t afford to pay these off. Starting this JAN sadly his insurance was cut off and I had to take it out, its $400 a month less that I am making. So while I thought I could just pay these off now because of my insurance I just can’t and I got my self into this horribe circle. I don’t want to close my bank account, nor do I want these lenders calling my job. Any GOOD positive adivce would be appreciated. I would love for them to stop debiting the finance charge and set up monthly repayments? Not sure they will do this though. HELP!!! Please

Closing your bank account won’t solve the problem. Just force them to sue you. Closing the bank account does not get you out of the loan.

The only way out is to pay it off. As you’ve learned, getting another pay day loan is not the answer.

Look around the house. What can you sell? Any clothes that are in good condition? Electronics? Anything you can list on Craig’s List and Ebay. Donate blood plasma if you have to.

Do you have a flea market in your town? If so, are you crafty? Do you have the ability to make something you can sell. Is hubby a wood worker? Can he make things to sell?

Can you take on a weekend job? That added to the things you can sell will help chip away at the debt.

Hubby is not working. He’s going to have to start doing something. Spring is coming. Tell him to start putting up fliers and advertising that he will cut grass and do lawn work. Maybe he can’t work construction right now but landscaping companies should start cranking up soon. He needs to contact companies and see if he can get a job. He can contact the local day labor companies. Most of these don’t need skill workers – they need muscle. Maybe he can advertise as a rent a hubby. Do those little honey do things for folks who don’t have a hubby handy enough to do those little things. If he has too…tell Hubby to appy to every local pizza joint and start delivering pizzas. Hubby’s not working is not going to work any more. If he can’t do construction then he needs to get off his fanny and start doing something. And any 1 thing may not be enough. He may need to do every thing I’ve suggested. But unless he has a major illness that physically prevents him from working – he needs to start doing everything he can to contribute to the house hold income.

You don’t have a debt problem. You have an income problem. The only way that I see to get out of the trap is to cut your spending to the bare bones. The only time you see the inside of a restaurant is if you are working in it. Then you have to increase your income and get these loans paid off.

Have you tried taking things to the pawn shop?
They will give you cash, about 1/3 of the value of things.
If you fail to return the cash, they keep the items.
Do you own your car title free of loans?
Does your town have car-title lending services?
Have you tried going to your bank and simply asking for a short term loan?

Also consider family.
Take anything of value to them and ask them for cash.

If you are looking for an unsecured loan you prob will have a hard time getting it from any legit lender.

A bank might issue a credit card, depending on your credit. But no bank is going to issue a unsecured loan to anyone one right now. Even in good times, getting an unsecured loan from a bank is virtually impossible.

All those pay day and related loans charge high rates of interest like Guido on the street corner in the bad part of town. Avoid Guido.

Okay, I made some bad decisions and took out a couple payday loans, they are killing my paycheck each month. And, I have some high credit card bills because of my husbands illness. Before he got onto health insurance we were paying for his insulin (expensive) plus we have a 1 and 2 year old in daycare and diapers. So, I just wonder about debt conslidation. has anyone used it…? Does it really work….? Is is a good idea?

I would recommend to speak to a credit counselor. Make sure it’s from a non-profit, accredited place. They could advise you about things like a consolidation loan or if you needed more help like where they will work with your creditors to help you pay off your bills. My friend did it and paid off a lot of debt in something like 3 years. I think it’s a good idea.

okay so currently i am at a stand still financially. its kind of worrying me because i can barley make ends meet and i have no other financial support from anyone else. even financial advice for that matter. the only person i can turn to is my other half, however my other half if currently unemployed so that kind of makes matters a little worse, but its so hard to find him a job, we’ve like put it over 100 applications all over and no luck so far, but heres the thing. here is the question id like to ask and get SERIOUS advice and help with. I am 19 and I am in debt. not 10k debt, id say around 3k or so. out of everything, i believe what is hurting me most is the numerous payday loans i have out there that i have made to try and have extra cash in my pocket. what is hurting me every 2 weeks i get paid is renuing them, and i want to get out of them so badly so i could pay other things that i owe with my check and at least for once in these 5 hectic months have something to last me off of my check till the next check for like gas, food and such. i want to know what would be the best method in getting out of all these loans and start getting down to business. also if someone would happen to know where i would be able to make a debt consolidation loan or some kind of loan that would help someone like me out, esp with the fact that i am from louisiana and the economy sucks out here. i tried onemain financial however i couldnt b/c i needed a co signer and i dont have that. i want to try to find some kind of place that would let me borrow like 2k to get out of some of this debt.

other debts are 411.00 overdraft in one bank accnt, abt 400 owed to a credit card that i havent been paying on because i couldnt afford it. i also had to let my insurance lapse because i couldnt afford to pay it and that is 447 i owe to them and i guess on top of that what i will have to pay also to the dmv and that is about it. i need help of advice if possible. the reason why i believe i got into all this mess is because a while back i was trying to help someone and a loan that i had weeks before that and didnt pay back went to my accnt and took all my check and from then on i basically had to make loans every so often to keep money in my pocket. also on average i make 80 hrs a week at my job and get paid 9.50. i hope this helps the people that are reading this and are interested in my story. thank you for your support.

80 hours a week at your job? At $9.50/ hour?
You are getting 40 hours of overtime (time and a half).
^ Louisiana has laws on this.
With that kind of income, you should be able to get out of this mess easily.
Work on those pay day loans first.
Then work hard to get car insurance.
I believe Louisina is one of those states with napoleonic laws.
You could go to jail for driving without liability car insurance.

What credit card do I have a chance of getting with bad credit?

my credit score on experian is 524, I am looking for a credit card with low or no initial fees or yearly fees but I can have a high interest rate because I plan on paying it off each month to build up my credit. does anyone know a card that would be most likley to approve me with this criteria?

I was pre approved for first premier bank card but with all the fees it ended up being 250 – 300 debt before I would even spend a penny on the card. and thats before eve n knowing the balance.

im not looking to go into more debt, Ive been paying off debt I had from 8 years ago, for about a year now on a debt consolidation plan. for some reason it didn’t start showing i was paying current till january, even though I have been paying on the card since july. I contested the charges of being late paying and even called my debt consolidation organization to see what they can do about it. my credit score SHOULD NOT BE AS LOW AS IT IS!

the reason I want the credit card incase you are wondering, is I have to get a rental car and all rentals require a credit card. also we are short about $200 for our vacation because we didn’t budget having to get a rental. we are going to ride down with a friend to san antonio but now she has decided not to take her car. she doesn’t have good credit either. about as good as mine. so I cant have her get a rental.

this is why I cant get a prepaid card right now, I know they build on credit, I would like to get one, but you have to put money upfront and my money is going to be tight until half way through our vacation on the third when my hubbie gets paid.

then well have more than enough to pay off the the credit card

dont want to be condsidering pawning or payday loans because the interest is so high even when you pay on time unlike a credit card

Long Story Short, Back in 2008, I ended up paying off all of my credit debt and then ended up moving to another state to be with my girlfriend (moving to another state without another job lined up is a bad idea). After Maxing out all of my credit cards, being legally homeless for months on end and living out of a motel I finally made my way back home where my credit was destroyed. I am now trying to pick of the pieces but it has been difficult.

Tons of people always talk about how people with horrible credit can still get personal or debt consolidation loans. When when you look online all you see is spam or garbage. I’d like to get a personal loan so I can consolidate my bills and move out of my parent’s house. Does anyone know of any legit, useful places that provide a bad credit loan (not payday advances)?
All of my credit cards ended up going to collections. I am currently now making payments to those collectors. They all refused to let me make payments on my own; telling me that my word on paying wasn’t good enough and that I had to either allow automatic deductions or they’d simply garnish my wages. While I was able to get several down to 60% of the original debt, the only way they’d work with me was by setting up automatic payments. I am annoyed that I am trying to at least fix my credit and pay my debt and these people are being so frustrating.

All of them are bad… Really. They will do the same things you can do on your own and not have to pay for it. You do not get a loan to pay a loan.

I would call the creditors and try to work out a payment plan. They will work with you if you are diligent. Make sure that every agreement comes on paper from them before you make a payment. Do not allow automatic withdrawals from any account-period, meaning do not give anyone your bank account info or any type of info that will allow for a debit.

More then likely if you do not have assets and the banks will not give you a loan it’s not worth doing. The interest rates on a loan from a shark will be out of this world and your debt will cost you lts more in the long run.

Take your extra cash and start paying down the old debt. Start with the smallest debts first and work your way through them this way.

I have multiple title loans in phoenix az, can i do a debt consolidation with it?

I took out a few tile loans in phoenix az at former payday loan centers, but i dont own the vehicle so the loan centers are basically the 2nd lien holders, but not officially documented as one on the tiltle, so would i still be able to do a debt consolidation or can they legally go after my vehicle?
The loan centers are aware that i do not own my car, in arizona payday loans are illegal now, so they allow you to take a title loan even if u dont own the vehicle. guess its some kind of loop hole.

I didn’t purposely put myself in debt. My mother had major heart surgery, and I was paying all her bills and my bills, and resorted to using credit cards. my credit card debt isn’t huge, but it isn’t small either (it was 10k a year and a half ago). with the monthly payments i cut the bill in half. the only luxury i have in my cell, and its for emergency purposes only. besides her survivor’s benefits (which i don’t touch) i have my income. the apt is in need in repair and my super gives me broken promises, and the landlord doesn’t help either. I don’t even want a large loan; i’m talking about $1000, which i know i could pay back. between helping my mother with her bills, and my bills, my paycheck is nearly gone

Absolutely nowhere. No legitimate lender will go near you as you are in trouble with your current debts – as you have discovered, debt consolidation management programs are a “stay away” sign to lenders.

And to be honest, you should not be spending any money on renovations while you are in such debt trouble.

If you could be a kid again, would you look up to adults your age?

When I was a kid, I looked up to adults. In my own life I did ok and didn’t think it was that hard to be successful.

Now that I’m in my 30′s, I am disgusted by most of my so called “peers” around me. I wouldn’t respect any adults today if I were a kid.

I turn on the TV and see most adults act worse than my fifth grade class.

There are so many businesses out there waiting to make money off adults for their own incompetence, everything from rehab to payday loans to debt consolidation.

And the biggest joke is that people think it’s okay to live at home after they get out of school, forever.

How would you teach a kid to respect their elders when their elders need grown up supervision?

Does anyone else here feel this way?
Yeah I agree I was taught to always respect elders, too.. and I will probably be saying Sir and Ma’am until I die, which is good.. however, those are titles I find hard to attribute to anyone my own age, especially when I just sit back and watch people in public.

most of these payday loans limited to $1000 and some direct lenders can give up to $1500.is there any payday loan company that provide more?

What type of loan are you looking for? Frankly, looking for a lender online is not a good idea. There so many scammers out there preying on folks with bad credit. You really are better off going to a local bank or credit union. You may not qualify for a loan but at least you won’t be paying up front money to a scammer or exposing your personal info to ID theft.

How do I find a loan shark?

I am desperate for a personal loan for some significant legal fees for my husband’s custody case. We both have extremely poor credit, and the timeline is too small to have time to save up. My husband would just like to get a loan through a “shark,” but not a payday loan – like a personal lender. Any LEGIT suggestions welcome. Our credit scores are too low for prosper.com. :-(

Are you crazy? Do you REALLY want to do it?
The best way to do this is to ask your attorney to let you pay in installments. If this particular attorney wouldn’t do it for you, find another one. Many attorneys will ask for some amount upfront and then you pay the rest in installments. Usually they do it without charging you any interest, but if you offer to pay reasonable interest, they’ll go for it.
Of course, we are talking about normal, regular lawyers, not some very high priced “legal eagles.”
