is anyone aware of payday loan co. giving your bank info to third parties claiming you authorized debits?
I applied at a payday loan co. and 3 times I ended up with debits from my account. Twice was for $19 for applying but the kicker is when $49.99 was taken from my account for a secret cash card? I found out where it came from and they claim I checked yes to one of the boxes on a payday loan appl. authorizing this third party company to send a check through my bank ordering a secret cash card thats a prepaid debit card thats suppose to give me online privacy when purchasing and protect me from companies and people from getting my personal info. Now it seems like I need that very protection from the stupid people thats selling it or fraudulently debited my account! The bank told me that when I applied for the loan I authorized the third parties to debit my account for various things. My thing is If your applying for ONE thing such as a payday advance how can it’s friend tom who sells shoes, joe who sells dog food and mary who sells secret cash cards legially take that money out my bank ?
Besides if I needed to apply for a payday loan then I didnt have money in the first place for no secret cash card and the funny thing is I never even got the loan!

Can I take legal action against a website that stole my information and sold it?
The other day I was looking at payday loan sites (yes I know terrible idea) and I found one that interested me. I filled out the information they asked for (including my SSN and bank account number) and after I submitted it they immediately told me I didnt qualify. Right after that my inbox got flooded with spam. I get about 300 spam emails a day now. I also keep getting phone calls and texts that are just spam. Somebody also tried to access my bank account but the bank stopped them. I confronted the website via online live chat (their phones “are not currently working”) and they swear up and down they dont spam and that its not from them. It has to be though because I never got spam before that and a majority of the spam was for payday loans. I want to know if there is some kind of legal action I can take against this site. They stole it because it was a loan application. They sold it to a bunch of spam sites so yes, I would consider that stealing. Seeing as they do not provide loans and just spam you, I would consider that stealing.
Wow spammers are so fucking retarded. Im asking if I can take a spammer to court and I get a bunch of spam replies offering me loans. I hate the internet.

A couple of issues…
The website did not steal your information. You typed it in and gave it to them.
Was there anything on the application that stated that your personal information would not be shared with anyone else? Lots of sites will sell or share e-mail lists with other companies, resulting in spam mail.
The violation I see offhand is the attempted entry into your bank account. I do not know how detailed the records are that your bank keeps, such as the address/name of the entity that was trying to access the account. Also bear in mind that you gave the loan site your bank account number. Did you read all the fine print? There may have been wording in there stating that by giving them your account number you were authorizing them to access the account. You need to be very careful about throwing around that information.
I seriously doubt that your computer has been hacked. The issue started after accessing and leaving information on another site, so if anyplace was hacked, it would be the website.

I am a 27 year old who has a great job, yet has found himself in trouble with STUPID payday loans. I have a finance degree and cannot believe i have found myself facing this taboo topic of bankruptcy. Though i make good money, i cannot pay off these loans nor my bills. i feel bankruptcy will enable me to afford the simple things…i.e groceries. i have a meeting next week, i feel its my only choice…yes, my debt is consolidated and thats not helping…and creditors still call my work

I’m sorry that you appear to be yet another victim of the “cash advance cancer”. With the new stricter predatory lending laws in place, protecting consumers the carnage left behind from these “sharks” should cease.
I can not advise whether it would be beneficial for you to pursue bankrupt.
I would recommend that you look into it as only a last resort – remember those laws have changed as well .
Your young enough to make a financial recovery that does not involve having that on your credit record potentially harming you more than a few paid collections that will disappear 3 years earlier that a bankruptcy – a without the stigma.
Meanwhile, I wish you well on your recovery from the shark bite.

Yeah I was dumb, the checking and savings where never tied together.The payday loan tried to force it open, before the due date of the check, so I closed out the checking account,yes I have to pay them but not thru my savings account? The payday loan co. is not giving us the time they promised, an never tell you of the hidden costs,the savings is to pay for new teeth, when my dental work is done, which is $700. the Cardiologist told me I needed this done,for the teeth are causing damage to my heart an blood chemistry,I’ve already paid half of dental work,I must use the savings accuont to complete the dental work,would the bank tell the Pay-day loan co.about the savings account?Is the bank requried to tell them? plzz need your help, thank you,very much.

I honestly do not think the bank can legally give your financial information to anyone or place of business without a conscent form signed by you. Unless while applying for the loan you signed an agreement to have your savings withdrawn in the event of nonpayment of the loan. (which I doubt considering it deals with checking accounts and not savings). The only account number the payday loan co has is your checking and you since have closed it. I will tell you that by not paying the loan you have created a big problem for yourself. The payday co has a legalized document signed by you and your promise to pay. It will go to court and it will cost you BIG TIME!!! They then will cease your savings and possibly garnish your wages by holding a judgement against you. This happens every day to many people who end up in the payday loan trap. Be smart and don’t let it go this far. You will end up paying three times the amount of the loan including late fees and court costs. As far as the unknown hidden costs you speak of. When applying for the loan you should have gotten a reciept or paper explaining the costs, interest, and the due date.

They do actually. It’s a new trend. Both of the banks that I bank with – Wells Fargo and Bank of America offer payday advances. They are offered only to established customers of their bank and the amounts are determined by the amount of income you have regularly deposited into that account.
As with any payday advance, it should be avoided like the black plague and never touched. Even with these two large financial institutions, their fees and interest charges are outrageous.
If you don’t have the money now for something (including emergencies) what makes you think you’ll have it later to pay back?

I’m very puzzled about the different terms when it comes to loans and this is one of them. I know that unsecured loans mean you can borrow money from lenders without collateral but you have to make sure your credit score is high. Am I right? If not, please explain. Then, what is guaranteed unsecured loan? Is payday loan also a type of unsecured loan?

Any loan which is made without pledging collateral. Home loans are secured by a deed of trust on the home. Car loans are secured by an endorsement on the title naming a lien holder, etc.
Credit scores do not necessarily come into play. You could borrow money from your uncle or a friend without any collateral other than a handshake or a promise.
A guaranteed unsecured loan is an oxymoron. The guarantor is liable in the event that you default and more than likely in a better credit position than you the borrower. That’s why the guarantor is acceptable to the lender.

Bad Credit Loans for Debt Consolidation?
Long Story Short, Back in 2008, I ended up paying off all of my credit debt and then ended up moving to another state to be with my girlfriend (moving to another state without another job lined up is a bad idea). After Maxing out all of my credit cards, being legally homeless for months on end and living out of a motel I finally made my way back home where my credit was destroyed. I am now trying to pick of the pieces but it has been difficult.
Tons of people always talk about how people with horrible credit can still get personal or debt consolidation loans. When when you look online all you see is spam or garbage. I’d like to get a personal loan so I can consolidate my bills and move out of my parent’s house. Does anyone know of any legit, useful places that provide a bad credit loan (not payday advances)?
All of my credit cards ended up going to collections. I am currently now making payments to those collectors. They all refused to let me make payments on my own; telling me that my word on paying wasn’t good enough and that I had to either allow automatic deductions or they’d simply garnish my wages. While I was able to get several down to 60% of the original debt, the only way they’d work with me was by setting up automatic payments. I am annoyed that I am trying to at least fix my credit and pay my debt and these people are being so frustrating.

All of them are bad… Really. They will do the same things you can do on your own and not have to pay for it. You do not get a loan to pay a loan.
I would call the creditors and try to work out a payment plan. They will work with you if you are diligent. Make sure that every agreement comes on paper from them before you make a payment. Do not allow automatic withdrawals from any account-period, meaning do not give anyone your bank account info or any type of info that will allow for a debit.
More then likely if you do not have assets and the banks will not give you a loan it’s not worth doing. The interest rates on a loan from a shark will be out of this world and your debt will cost you lts more in the long run.
Take your extra cash and start paying down the old debt. Start with the smallest debts first and work your way through them this way.

I took out a few tile loans in phoenix az at former payday loan centers, but i dont own the vehicle so the loan centers are basically the 2nd lien holders, but not officially documented as one on the tiltle, so would i still be able to do a debt consolidation or can they legally go after my vehicle?

I didn’t purposely put myself in debt. My mother had major heart surgery, and I was paying all her bills and my bills, and resorted to using credit cards. my credit card debt isn’t huge, but it isn’t small either (it was 10k a year and a half ago). with the monthly payments i cut the bill in half. the only luxury i have in my cell, and its for emergency purposes only. besides her survivor’s benefits (which i don’t touch) i have my income. the apt is in need in repair and my super gives me broken promises, and the landlord doesn’t help either. I don’t even want a large loan; i’m talking about $1000, which i know i could pay back. between helping my mother with her bills, and my bills, my paycheck is nearly gone

Absolutely nowhere. No legitimate lender will go near you as you are in trouble with your current debts – as you have discovered, debt consolidation management programs are a “stay away” sign to lenders.
And to be honest, you should not be spending any money on renovations while you are in such debt trouble.

If you could be a kid again, would you look up to adults your age?
When I was a kid, I looked up to adults. In my own life I did ok and didn’t think it was that hard to be successful.
Now that I’m in my 30′s, I am disgusted by most of my so called “peers” around me. I wouldn’t respect any adults today if I were a kid.
I turn on the TV and see most adults act worse than my fifth grade class.
There are so many businesses out there waiting to make money off adults for their own incompetence, everything from rehab to payday loans to debt consolidation.
And the biggest joke is that people think it’s okay to live at home after they get out of school, forever.
How would you teach a kid to respect their elders when their elders need grown up supervision?
Does anyone else here feel this way?
Yeah I agree I was taught to always respect elders, too.. and I will probably be saying Sir and Ma’am until I die, which is good.. however, those are titles I find hard to attribute to anyone my own age, especially when I just sit back and watch people in public.

Don’t get into debt to pay off other debts, write to who you owe the money to and make an arrangement, much better in long run. Borrowing more money will just escalate your problem. Trust me I have leaned from experience while running up a £15k debt

Can I be held responsible for a payday loan I never signed for?
My information was apparently given out when I was on a web site which said it would match me with a lender. A company called Ace Cash Services deposited 300 in our account without us ever asking them for a loan or signing anything. They now say I owe them 510! I told them I would be more than happy to give them the 300 but no more. What are my legal rights?

If you did not want the loan then clearly you should have given out your checking account/bank transit number. The bad thing here is that these people have everything they need to start debiting money from your checking account…even if the money is not there. You’re going to have to pay them $510….sorry. It’s safe to assume that if you don’t make your own payment arrangements, then expect them to try to debit $510 from your checking account within 2 days.
If the money is not there, then you need to close your checking account…otherwise your account will go hundreds of dollars into a negative balance and you’ll have another separate problem to deal with.
Offer to settle the loan for $400 and see what they say…get a signed agreement to these terms FIRST, then send a money order for this amount. If you do nothing, then in about 3 months you can expect the amount you owe to skyrocket to over $2,000.

I am searching for all of those alleged high risk lenders that are willing to lend money for those with credit scores in the low 500′s. I am not interested in payday advances. My wife took a $10,000 a year net pay cut this year and we are struggling to keep it together. We had a little girl last year and my wife was out for 7 months. We are still paying off medical bills.
We have consolidated all of our debt and credit cards and cut them up. I am so through with CC. We are too comfortable using them. We restructured our finances and eliminated the fluff. Now we are down to the house, car, food, electric. I need help to pay off 4 payday loan companies I had to turn to during my worst months this year just to keep the lights on. I will thank those in advance who will say…live simply and things will get better…I work 60+ hours a day and between the two of us we bring home more than 7.5 K monthly…the payday loans will not let us get back on track. My family is not able to help much.

Are there really people out there that will loan money?
I’m not talking banks, or payday loan places, I am talking legit private lenders that will loan you money? You hear about private lenders that will lend money, but I can’t seem to find anything legit or worthwhile. A 100-500 dollar loan is not worthwhile and it’s not legit if you have to PAY to get your loan.
Has anyone had any success with finding what it is I am looking for?

Yes, I actually do what it is you’re speaking of. Not small loans, but loans between 10-100k+. It’s quite an interesting process which centers around what you offer for collateral.
For example, if you have a home worth 100k and have it paid off, or even mostly, it’s pretty easy to get a loan, even with very poor credit. If you have a business, and are struggling to get a loan, if you have assets (equipment, accounts receivable, contracts, real estate, etc), there are people who specialize in loans on business assets.
Expect to pay a high interest rate and sometimes a high origination fee.
